PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for a service lane and shall vest in The Tauranga City Council on the 24th day of October 1985.

Declaring a Sewer Line Easement Acquired for a State Primary School in Block V, Waiheke Survey District, Waiheke County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that an agreement to that effect having been entered into, a sewer line easement over the land described in the First Schedule hereto vesting in the Crown the rights and powers contained in paragraphs 4 and 5 in the Seventh Schedule of the Land Transfer Act 1952 and in the Second Schedule hereto, is hereby acquired for a State primary school on the 24th day of October 1985.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Servient Land

ALL that piece of land containing 88 square metres, situated in Block V, Waiheke Survey District, being part Lot 212, D.P. 16345; as shown marked ‘A’ on S.O. Plan 59247, lodged in the office of the Chief Surveyor at Auckland.

SECOND SCHEDULE

Description of Easement

HER Majesty the Queen (hereinafter called “the grantee”) shall have a right of entry at all reasonable times with all requisite machinery and conveyances for the purpose of laying, maintaining, repairing, or renewing the said sewer line.

The grantor will not do any act which will prevent or interfere with the operation of the said sewer line or prevent or interfere with the full use and enjoyment by the grantee of the right hereby granted.

The grantor shall not have the right to connect into the said sewer line but in the event of the said sewer line becoming part of the proposed Waiheke County Council sewage disposal system the grantor shall have the right to connect into the said sewer line.

The Minister may at any time surrender the easement by notice in the Gazette pursuant to section 42 (4) (c) of the Public Works Act 1981.
