Indecent Publications and Road Declarations

Companion (October 1983) is similar in style to Hustler having the usual collection of nude models, letters and jokes. These are generally orientated towards sex. The pictorial section contained in pages 77 to 89 are, Mr Simpson said, particularly graphic. None of the articles have any serious content whilst the cartoons are in bad taste. We agree with Mr Simpson that this publication is on a par with Hustler.

Chic magazines have been considered by the Tribunal on earlier occasions and by Decision Nos 1041 and 2/84 two earlier volumes were classified as indecent. The five copies now submitted are not significantly different. All contravene the standards laid down in Decision Nos 1053 and 1054.

Men Only magazines have been considered by the Tribunal previously (Decision Nos 876, 1034 and 1041). In each case they have been classified as indecent. The current editions are not greatly different from earlier issues but Volume 48, Nos 12 and 49 No. 2 are using multiple model lesbian scenes. This is a new development. We see no reason for changing our earlier stance so far as these magazines are concerned.

Genesis: We had occasion to consider several earlier issues of this publication when they were classified as indecent in the hands of persons under the age of 18. The importer in this case is not Gordon and Gotch (N.Z.) Ltd. which had caused the earlier editions to be submitted to the Tribunal for classification. Having learnt of this bearing Mr Ellis appeared on behalf of Gordon and Gotch (N.Z.) Ltd. and sought leave to make submissions as a 'person likely to be affected'. Apparently the company is considering importing further issues of this publication so that if it is to be classified as indecent that order will have to be cancelled. Leave was granted to Mr Ellis who made submissions along the lines made earlier and with the submission that the issues now before us are not significantly different from those submitted earlier. We agree.

Eros Catalogue, Companion, Chic and Men Only are classified as unconditionally indecent. So far as Chic and Men Only are concerned there will be a restriction order under section 15A for a period of 2 years.

Genesis will be classified as indecent in the hands of persons under the age of 18.

Redeclaring State Highway to be a Limited Access Road State Highway No. 2

It is notified that the National Roads Board, by resolution dated 17 October 1984 and pursuant to section 153 of the Public Works Act 1981, hereby declares that part of State Highway No. 2, Te Maraua to Akatarawa Road section, for its full width across the frontages of Lot 2, D.P. 25570, certificate of title 25A/834 including Area B on S.O. 33352 as more particularly shown on Sheet 1, Plan LA 51/18/58 and accompanying Schedule held in the office of the Resident Engineer, Ministry of Works and Development, Trentham and there available for public inspection, to be a limited access road.

Redeclaring State Highway to be a Limited Access Road State Highway No. 2

It is notified that the National Roads Board, by resolution dated 17 October 1984 and pursuant to section 153 of the Public Works Act 1981, hereby declares that part of State Highway No. 2, upper Akatarawa Road to Masterton section, for a width of 13 metres on the western side commencing 1800 metres south of Upper Akatarawa Road (Paierau Road) and extending southwards for 200 metres across the frontages of Lots 1 and 2, D.P. 52448, certificates of title 22A/764 and 765 respectively as more particularly shown on Sheet 1, Plan LA 51/14/3 and accompanying Schedule held in the office of the Resident Engineer, Ministry of Works and Development, Trentham and there available for public inspection, to be a limited access road.

It is notified that the National Roads Board, by resolution dated 17 October 1984 and pursuant to section 153 of the Public Works Act 1981, hereby declares that part of State Highway No. 2, Pahiatua to Woodville section, for its full width across the frontages of Lot 1, D.P. 25912 in certificate of titles 23A/139 and 140 respectively and more particularly shown on Sheet 1, Plan LA 51/10/53 and accompanying Schedule held in the office of the Resident Engineer, Ministry of Works and Development, Palmerston North and there available for public inspection, to be a limited access road.

It is notified that the National Roads Board, by resolution dated 17 October 1984 and pursuant to section 153 of the Public Works Act 1981, hereby declares that part of State Highway No. 1, Paraparaumu to Paekakariki section, for half its width on the southern side commencing 96 metres east of the eastern boundary of Lot 1, D.P. 47726 and extending 12 metres eastwards across the frontages of Lot 1, D.P. 53032, certificate of title 244/201 and part Lot 3, D.P. 4269, certificate of title 244/201 as more particularly shown on Sheet 1, Plan LA 52/5/11 and accompanying Schedule held in the office of the Resident Engineer, Ministry of Works and Development, Porirua and there available for public inspection, to be a limited access road.
