Insurance Companies’ Deposits Act 1953—Proposed Release of Deposit
FRANK FORDHAM LIMITED ("the Company") has given notice to the Public Trustee that it has ceased to carry on the classes of insurance business in New Zealand designated as classes 1 and 4 in the First Schedule of the Insurance Companies’ Deposits Act 1953 ("the Act") and that pursuant to section 19 of the Act proposes to withdraw the deposit which it has made with the Public Trustee.
The Public Trustee therefore gives notice pursuant to section 19 (3) of the Act that on being satisfied that all liabilities of the company in New Zealand in respect of such insurance business have been fully liquidated or provided for, he proposes to release the deposit to the company on or after 18 February 1985.
Any objections to the release of the deposit should be lodged with the Public Trustee, Lambton Quay, Wellington on or before 15 February 1985.
Dated at Wellington this 14th day of December 1984.
W. B. R. HAWKINS, Public Trustee.
Decision No. 26/84
Reference No. Ind. 15/84
Before the Indecent Publications Tribunal
In THE MATTER of the Indecent Publications Act 1963, and IN THE MATTER of an application by the Comptroller of Customs for a decision in respect of the following publications:
Sex and the Married Woman published by Dianne Grosskopf and Playgirl Posters—Men of the Decade, published by Playgirl Inc., U.S.A.
Chairman: Judge W. M. Willis.
Mesdames: H. B. Dick and L. P. Nikora.
Messrs: J. V. B. McLinden and I. W. Malcolm.
Hearing: Wellington, 8 November 1984.
Appearances: Written submissions from Importer, Waiverley Publishing Co. Ltd. R. A. Simpson for Comptroller of Customs.
DECISION
These publications were imported in May 1984 and were seized. Forfeiture has been disputed so that they are referred for classification.
The publication Playgirl Posters has 12 photographs of nude males with all but 2 displaying genitalia. There is no accompanying text except that statistical data relating to each model is present. The publication has no literary or artistic qualities but by the same token there is nothing really offensive about it.
Sex and the Married Woman covers sexual activity from a married woman’s point of view. It is compiled from interviews and the result of a questionnaire. There is ample statistical data. The book is written in plain terms and is tastefully presented. It does not dwell on psychological and technical aspects and would have some appeal to female readers. In some respects it resembles sex manuals which we have classified as indecent in the hands of persons under the age of 18.
In the Tribunal’s view there is no reason to classify these publications as indecent. Accordingly they are each classified indecent in the hands of persons under the age of 18.
Dated at Wellington this 14th day of December 1984.
JUDGE W. M. WILLIS, Chairman.
Decision No. 25/84
Reference No. Ind. 20/84
Before the Indecent Publications Tribunal
In THE MATTER of the Indecent Publications Act 1963, and IN THE MATTER of an application by the Comptroller of Customs for a decision in respect of the following publications:
Eros Catalogue, Publisher unknown.
Companion (October 1983), published by Gentleman’s Companion Inc., U.S.A.
Chic (Volume 8, Nos 1, 4, 5, 6, and 7), published by L. F. P. Inc., U.S.A.
Men Only (Volume 48, Nos 8, 9, 10, 11, 12) (Volume 49, No. 2), published by Paul Raymond Publications Ltd., London.
Genesis (Volume 11, Nos 6, 8, 9, 10, 11), published in Cycle Guide Publications Inc., U.S.A.
Chairman: Judge W. M. Willis.
Mesdames: H. B. Dick and L. P. Nikora.
Messrs: J. V. B. McLinden and I. W. Malcolm.
Hearing: Wellington, 8 November 1984.
Appearances: No appearance for Importer, A. R. Paton. G. H. Ellis for Gordon and Gotch (N.Z.) Ltd. in respect of Genesis, R. A. Simpson for Comptroller of Customs.
DECISION
All these publications were imported by one man through Hamilton during the past 18 months. All have been seized but the importer has not disputed seizure. However, the Comptroller has decided to prosecute under section 48 of the Customs Act 1966. This of course necessitates a classification as a preliminary.
Eros Catalogue is a mail order catalogue for the various sex products and aids available from Eros Products, Australia. It contains many photographs depicting heterosexual and homosexual activities. Some of them are gross and would have appeal only for the lewd and the prurient. There can be no claim to literary or artistic merit.
