PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, the land described in the Schedule hereto
is hereby acquired for the purposes of the Fire Service Act 1975
and shall vest in the New Zealand Fire Service Commission on the
18th day of April 1984.

Declaring a Water Supply Pipeline Easement, Acquired for a
State Primary School in Block V, Mangonui Survey District,
Mangonui County

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, a water supply pipeline easement, over
the land described in the First Schedule hereto, appurtenant to the
land described in the Second Schedule hereto, and subject to the
rights and imposing the conditions contained in the Third Schedule
hereto is hereby acquired for a State primary school and shall vest
in the Crown on the 18th day of April 1984.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Servient Tenement

ALL that piece of land containing 35 square metres, being part Lot
1 on D.P. 62771, and being more particularly marked “I” on S.O.
Plan 57394.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Dominant Tenement

ALL that piece of land containing 3 roods and 4 perches (3136 square
metres), situated in Block V, Mangonui Survey District and being
Allotment 48, Parish of Mangonui; as shown on S.O. plan 3737A,
lodged in the office of the Chief Surveyor at Auckland.

THIRD SCHEDULE

NORTH AUCKLAND LAND DISTRICT

THE register proprietors shall grant to the Crown full right, liberty,
licence and authority in perpetuity to draw, carry and convey water
in free and unimpeded flow from the bore situated on the registered
proprietor’s property by means of a line of water pipes and related
equipment through, on or under that portion of the registered
proprietor’s property over which the easement is granted and shall
grant to the Crown, her servants, agents, engineers and workmen
with or without any necessary vehicles, implements, tools and
materials of any kind full and free right, liberty, licence and authority
to lay, place, service, and maintain and from time to time renew
the aforesaid bore, line of water pipes and related equipment and
to open up the soil of the aforesaid portion of the registered
proprietor’s property as necessary to carry out such work.

The Crown, her servants, agents, engineers and workmen in
exercising the rights and privileges granted by the registered
proprietors, will cause as little damage as reasonably possible to
the surface of the registered proprietor’s property and at no cost to
the registered proprietor restore the said surface to its former condition
as nearly as possible.

The registered proprietors shall be permitted to connect and lead
from the line of water pipes, one subsidiary line of water pipes with
a connection not exceeding nineteen millimetres (19 mm) in diameter
during the continuance of the easement for the purposes of drawing
water from the Crown’s water supply to supplement the registered
proprietor’s existing water supply provided however the registered
proprietor’s will not unreasonably restrict or impede the flow of
water to the property of the Crown.

That the Crown may at any time on giving to the registered
proprietor written notice in that behalf, surrender and extinguish
the easement and in so doing may enter by her servants, agents,
engineers, and workmen on, the aforesaid portion of the registered
proprietor’s property with or without any necessary vehicles,
implements, tools and material of any kind for the purpose of
uplifting and removing the said line of water pipes land related
equipment restoring the surface of the registered proprietor’s property
as nearly as possible to its former condition.
