Rights and Obligations Under Easement to Support Retaining Wall

1. The Crown together with its agents, servants, workmen and employees may enter upon the servient land at all times and generally do and perform all such acts and things as may be necessary or convenient for the maintenance of the integrity of the wall and anchorage system for the life of the wall.

2. The registered proprietor shall not at any time do or suffer any act or thing which will affect or damage the anchorage system of the wall or prevent or interfere with the full and free use and enjoyment by the Crown of the rights and privileges created by this declaration and in particular shall not increase the ground loadings beyond those existing as at 3 June 1982 and shall not carry out any excavation or construct any piles or foundations exceeding 1 metre in depth below the ground level as at 3 June 1982, without first obtaining the written permission of the District Commissioner of Works at Auckland.

3. For the purpose of paragraph 2 of this Schedule “ground loadings” shall mean “the weight of any building or structures existing at the said time together with the weight of any vehicles, plant or matter or thing deposited on the surface of the servient land by the registered proprietor’s licensees, servants and agents, and employees in the course of the registered proprietor’s usual business activities”.
