The Invercargill City Council Foreshore and Waters Control Order 1984

At the Government House at Wellington this 16th day of July 1984

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to sections 8A and 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

Title and commencement—(1) This order may be cited as the Invercargill City Council Foreshore and Waters Control Order 1984. (2) This order shall come into force on the 1st day of September 1984.

Interpretation—In this order—
“The Act” means the Harbours Act 1950.
“The Council” means the Invercargill City Council constituted under the Local Government Act 1974.
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.
- Grant of Control—There is hereby granted to the Council for a period of 21 years from the 1st day of September 1984 and ending with the 31st day of August 2005.
(a) Control of the foreshore described in the First Schedule to this order.
(b) Control of the waters described in the Second Schedule to this order.
- Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions:
(a) Suitably worded signs shall be erected at main public access ways to the foreshore and waters described in the Schedules to this order indicating that control of them has been granted to the Council pursuant to sections 8A and 165 of the Act.
(b) All money received by the Council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore and waters to which this order applies shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore and waters and not otherwise.
- Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the waters to which this order applies:
(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act.
(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.
- Revocation—The following order is hereby revoked:

FIRST SCHEDULE
ALL that area of foreshore commencing at a point at high water mark on the southern bank at the mouth of the Waimatuku Stream thence in a southerly direction to the mouth of the New River Harbour at its northern shore, thence into the New River Harbour and Oreti River upstream to Dunns Road Bridge and the Waihopai River upstream to the Railway Bridge, thence to the mouth of New River Harbour at the Southern shore, thence westerly and southerly to Barracouta Point but excluding therefrom any endowment foreshore or lands in the vicinity of New River Harbour or its entrance; the limits of which are more particularly shown coloured red on plan MD 16130, deposited in the office of the Secretary for Transport at Wellington.

SECOND SCHEDULE
ALL that area of water enclosed by a line commencing at the waters edge at high water spring level on the left bank of the Waimatuku Stream, at its mouth, thence generally westward to a point 200 metres seaward of the waters edge; then south-eastwards and 200 metres from the waters edge to a point 200 metres due west of the Trig Station Z in Part 6, Block 23, New River HD, thence in a straight line to the eastern most point of Omaui Island at the waters edge, thence in a straight line to a point 200 metres due west of Steep Head; thence continuing generally southwards 200 metres seaward of the waters edge to a point 200 metres due west of Barracouta Point, thence eastwards to a point at the waters edge at Barracouta Point, at high water spring tide.
Including all that tidal water of the New River Harbour upstream to Dunns Road Bridge and Waihopai River upstream to the Railway Bridge and as more particularly shown on plan MD 16230, deposited in the office of the Secretary for Transport at Wellington.

EXPLANATORY NOTE
This note is not part of the order but is intended to indicate the general effect.
The Invercargill City Council is granted by the Order control of the foreshore and waters of Oreti Beach, New River Harbour, the Oreti River downstream of the Dunns Road Bridge, the Waihopai River and the foreshore and waters southward to Barracouta Point.

Promotion
Flying Officer R. I. Fyfe to be Flight Lieutenant with seniority and effect from 15 July 1984.
Extension of Commission
The commission of Flight Lieutenant G. J. Ross is extended to 6 October 1991.
Extension of Commission and Age for Retirement
The commission and age for retirement of Squadron Leader W. A. K. Currie, B.E.M., are extended to 30 July 1987.
The commission and age for retirement of Squadron Leader J. J. Keegan, B.E.M., are extended to 15 February 1990.
Retirement
