Declaring Separate Constituent Districts for the Purposes of Representation on the Manawatu Catchment Board and Reapportioning Representation on that Board

At the Government House at Wellington this 26th day of April 1983.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby—

(a) Declares the wards described in the First Schedule hereto, being wards situated within the Manawatu Catchment District, to be separate constituent districts for the purposes of the Soil Conservation and Rivers Control Act 1941; and

(b) Amends the Order in Council dated 11 August 1943, published in the Gazette of 2 August 1943, No. 66, page 975, declaring the number of members and apportioning representation on the Manawatu Catchment Board, by deleting the Schedule thereto and substituting the Schedule contained in the Second Schedule hereto.

The Auckland City Council and Auckland Harbour Board Foreshore Control Order 1983

ORDER IN COUNCIL

At the Government Buildings at Wellington this 5th day of April 1983.

Present:

THE RIGHT HON. D. MACINTYRE PRESIDING IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

  1. Title and commencement—(1) This order may be cited as the Auckland City Council and Auckland Harbour Board Foreshore Control Order 1983.

(2) This order shall come into force on the 1st day of April 1983.

  1. Interpretation—In this order:

“The Act” means the Harbours Act 1950.

“The Council” means the Auckland City Council constituted under the Local Government Act 1974.

“The Board” means the Auckland Harbour Board constituted under the Harbours Act 1950.

“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby jointly granted to the Council and the Board for a period of 21 years from the 1st day of April 1983 and ending with the 31st day of March 2004 control of the foreshore described in Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions:

(a) Suitably worded signs shall be erected at main public access ways to the foreshore described in the Schedule to this order indicating that control of it has been granted to the Council and Board pursuant to section 165 of the Act.

(b) All money received by the Council and Board in the performance or exercise of the functions, duties, or powers conferred on them by this order in respect of the foreshore to which this order applies, shall, after the deduction of any expenditure incurred by the Council and Board in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore and not otherwise.


SCHEDULE

ALL those areas of foreshore of the Manukau and Waitemata Harbours described below and as more particularly shown red on plan M.D. 16148, deposited in the office of the Secretary for Transport at Wellington:

WAITEMATA HARBOUR

(a) The foreshore beginning at the northern side of the junction of the North-Western Motorway and the mainland at Oakley Creek at a point marked A and ending at the junction of Curran Street extension with the Auckland Harbour Bridge approach road at a point marked B; as shown on plan M.D. 16148.

(b) The foreshore of Judges Bay marked C; as shown on plan M.D. 16148.

(c) The foreshore beginning on the northern side of Tamaki Drive at its junction with Okahu Street at a point marked D and ending on the western side of the Tamaki River at the boundary of the districts of Auckland City Council and Mount Wellington Borough Council at a point marked E; as shown on plan M.D. 16148.
