Land Taken for Road in the City of Waitemata

A PROCLAMATION
PURSUANT to the Public Works Act 1981, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, hereby declare the land described in the Schedule hereto to be taken for road, and to be vested in The Waitemata City Council on the 14th day after the publication of this proclamation in the Gazette.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that piece of land containing 4221 square metres, situated in the City of Waitemata and being part Lot 10, D.P. 670; as shown marked ‘A’ on S.O. Plan 56351, lodged in the office of the Chief Surveyor at Auckland.

The Waitomo District Council Foreshore, Riverbed, and Waters Control Order 1983

ORDER IN COUNCIL
At the Government House at Wellington this 18th day of April 1983
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to sections 8A and 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
-
Title and commencement—(1) This order may be cited as the Waitomo District Council Foreshore, Riverbed, and Waters Control Order 1983.
(2) This order shall come into force on the 1st day of May 1983. -
Interpretation—In this order—
“The Act” means the Harbours Act 1950:
“The Council” means the Waitomo District Council constituted under the Local Government Act 1974:
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides. -
Grant of Control—This is hereby granted to the Council for a period of 21 years from the 1st day of May 1983 and ending with the 30th day of April 2004.
(a) Control of the foreshore, and riverbed described in the First Schedule to this order.
(b) Control of the waters described in the Second Schedule to this order. -
Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—
(a) Suitably worded signs shall be erected at main public access ways to the foreshore, riverbed, and waters described in the Schedules to this order indicating that control of them has been granted to the Council pursuant to sections 8A and 165 of the Act.
(b) All money received by the Council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore, riverbed, and waters to which this order applies, shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore, riverbed, and waters and not otherwise. -
Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the foreshore, riverbed, and waters to which this order applies—
(a) By bylaws, do anything which a Harbour Board may do by bylaw under section 232 of the Act.
(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.
FIRST SCHEDULE
FIRSTLY, all that area of foreshore commencing from a point on the southern bank of the mouth of the Mokau River; thence generally northwards past Tirau Point and Albatross Point to a point being the southern extent of the Limits of Kawhia Harbour, excluding thereout all that area of foreshore within Taharoa Harbour Limits. The area is as shown more particularly coloured red on plan M.D. 16142, deposited in the office of the Secretary for Transport at Wellington.
Secondly, all those areas of foreshore and riverbed of the Awakino and Marokopa Rivers from their source to the sea, and of the Mokau River from approximately 1 kilometre upstream of the Wairee Dam to the sea; as shown more particularly coloured blue on plan M.D. 16142, deposited in the office of the Secretary for Transport at Wellington.
SECOND SCHEDULE
FIRSTLY, all that area of water enclosed by a line commencing from a point at the waters edge on the southern bank at the mouth of the Mokau River; thence generally in a westerly direction to a point 200 metres from the waters edge; thence generally in a northerly direction past Tirau Point and Albatross Point, and 200 metres seaward from the waters edge, to a point being the southern extent of the Limits of Kawhia Harbour; excluding thereout all that area of water within Taharoa Harbour Limits. The area is as shown more particularly coloured red on plan M.D. 16142, deposited in the office of the Secretary for Transport at Wellington.
Secondly, all those areas of water of the Awakino and Marokopa Rivers from their source to the sea, and of the Mokau River from approximately 1 kilometre upstream of the Wairee Dam to the sea, as shown more particularly coloured blue on plan M.D. 16142, deposited in the office of the Secretary for Transport at Wellington.

EXPLANATORY NOTICE
This note is not part of the order, but is intended to indicate the area subject to the order.
The areas described in the Schedules to this order include the following:
(a) The foreshore from the Mokau River to the southern limits of Kawhia Harbour, excluding Taharoa Harbour.
(b) The foreshore and riverbed of the Awakino and Marokopa Rivers and of the Mokau River from 1 kilometre upstream of the Wairee Dam, to the sea.
(c) The waters within 200 metres of the waters edge from the Mokau River to the southern limits of Kawhia Harbour, excluding Taharoa Harbour.
(d) The waters of the Awakino and Marokopa Rivers and of the Mokau River from 1 kilometre upstream of the Wairee Dam, to the sea.
