Amending a Notice Proclaiming Land as Road and Road Closed and Vested in Block XVII, Porongahau Survey District, Waipukurau District

PURSUANT to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby amends the notice dated the 8th day of December 1981, published in Gazette, 17 December 1981, No. 151, at page 3813; proclaiming land as road and road closed and vested in Block XVII, Porongahau Survey District, Waipukurau District, pursuant to section 29 of the Public Works Amendment Act 1948, by omitting the words “mortgage Nos. 200958 and 347031.3, Hawke’s Bay Land Registry.”, and substituting the words “mortgage Nos. 200958, 347031.2 and 401638.2, Hawke’s Bay Land Registry.”.

Consent to the Generation of Electricity by David Alexander Harvey at Clova Bay by the Use of Water

PURSUANT to the Electricity Act 1968, the Minister of Energy hereby consents to the generation of electricity by David Alexander Harvey of Clova Bay by the use of water, subject to the following conditions.

CONDITIONS

1. The conditions directed by the Water Power Regulations 1934 to be implied in every licence to use water for the purpose of generating or storing electricity shall be deemed to be conditions of this consent as if it were such a licence.

2. This consent is subject to compliance with the Water Power Regulations 1934, the Electrical Supply Regulations 1976, the Electrical Wiring Regulations 1976, the Radio Interference Regulations 1958, and all regulations hereafter made in amendment of or in substitution for any of those regulations, as if in the case of the Water Power Regulations 1934 it were a licence under the Public Works Act 1928 to use water for the purpose of generating electricity as well as a consent under the Electricity Act 1968 to generate electricity by use of water.

3. The generation of electricity by the use of water pursuant to this consent shall be carried out by means of the works described in the Schedule hereto.

4. This consent shall, unless it is sooner lawfully determined, continue in force until the 31st day of March 2002.

5. This consent confers no rights to water under the Water and Soil Conservation Act 1967 or otherwise.

6. For the purpose of assessing the rental or annual sum payable in respect of this consent, the maximum generating capacity of the plant at the date of this consent is 5 kW.

SCHEDULE

GENERAL DESCRIPTION OF WORKS

(a) Headworks consisting of an intake water race, and dam, with a pipeline leading to the powerhouse giving a static head of approximately 107 metres.

(b) Pelton wheel and powerhouse with all necessary equipment for generating electricity.

(c) Tail race leading from the powerhouse to an unnamed stream.

As shown on the plan marked NZE 1024 deposited in the office of the Electricity Division, Ministry of Energy at Wellington.

Electric Lines Licence—Authorising David Alexander Harvey to Erect and Use Electric Lines

PURSUANT to the Electricity Act 1968, the Minister of Energy hereby licences David Alexander Harvey of Clova Bay subject to the following conditions, to lay, construct, put up, place and use the electric lines described in the Schedule hereto.

CONDITIONS

1. This licence is subject to compliance with the Electrical Supply Regulations 1976, the Electrical Wiring Regulations 1976, the Radio Interference Regulations 1958, and all regulations made in amendment of or in substitution for any of those regulations.

2. The systems of supply shall be as described in paragraph (j) of regulation 15 of the Electrical Supply Regulations 1976, and shall be a direct current system at a normal rated pressure of 110 volts.

3. This licence shall, unless it is sooner lawfully determined, continue in force until the 31st day of March 2002.

SCHEDULE

ELECTRIC lines leading from the powerhouse as follows:

1. In a south-easterly direction to a house.

2. In a south-westerly direction to a shed.

All being situated in Part 2, Section 27, Block IX, Orieri Survey District in the County of Marlborough as shown on the plan marked NZE 1024 deposited in the office of the Electricity Division, Ministry of Energy at Wellington.

The Traffic (Whangarei County) Notice No. 4, 1982

PURSUANT to the Transport Act 1962, the Minister of Transport hereby gives the following notice:

NOTICE

This notice may be cited as the Traffic (Whangarei County) Notice No. 4, 1982.

The roads specified in the First Schedule hereto are hereby declared to be closely populated localities for the purposes of section 52 of the Transport Act 1962.

The roads specified in the Second Schedule hereto are hereby declared to be 70 kilometres an hour speed limit areas pursuant to regulation 21 (2) of the Traffic Regulations 1976*.

The Traffic (Whangarei County) Notice No. 3, 1978, dated the 18th day of October 1978†, issued pursuant to section 52 of the Transport Act 1962, and regulation 21 (2) of the Traffic Regulations 1976, is hereby revoked.

FIRST SCHEDULE

SITUATED within Whangarei County at Ruakaka:

Bream Bay Drive.

Garland Road.

Marsden Point Road eastern accessway: from a point 200 metres measured southerly, generally, along the said road from Seaview Road to its northern end.
