ORDER
- Title and commencement—(1) This order may be cited as the Takapuna City Council Lakeshore, Lakebed and Waters Control Order 1982.
(2) This order shall come into force on the 1st day of December 1982.
- Interpretation—In this order—
“The Act” means the Harbours Act 1950;
“The Council” means the Takapuna City Council constituted under the Local Government Act 1974.

Grant of Control—There is hereby granted to the Council for a period of 21 years commencing with the 1st day of December 1982 and ending with the 30th day of November 2003 control of the lakeshore, lakebed and waters described in the Schedule to this order.

Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—
(a) Suitably worded signs shall be erected at main public accessways to the lakeshore, lakebed and waters described in the Schedule to this order indicating that control of them has been granted to the Council pursuant to sections 8A and 165 of the Act.
(b) All money received by the Council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the lakeshore, lakebed, and waters to which this order applies, shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that lakeshore, lakebed, or those waters and not otherwise.
- Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the lakeshore, lakebed and waters to which this order applies—
(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act.
(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.
SCHEDULE
All that area of lakeshore, lakebed and waters of Lake Pupuke situated in the City of Takapuna as more particularly shown on plan MD 16062 deposited in the office of the Secretary for Transport at Wellington.

The Kapiti Borough Council Waters Control Order 1982

At the Government House at Wellington this 15th day of November 1982.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 8A of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- Title and commencement—(1) This order may be cited as the Kapiti Borough Council Waters Control Order 1982.
(2) This order shall come into force on the 1st day of December 1982.
- Interpretation—In this order—
“The Act” means the Harbours Act 1950;
“The Council” means the Kapiti Borough Council constituted under the Local Government Act 1974.

Grant of Control—There is hereby granted to the Council for a period of 21 years commencing with the 1st day of December 1982 and ending with the 30th day of November 2003 control of the waters described in the Schedule to this order indicating that control of the water has been granted to the Council pursuant to section 8A of the Act.

Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the waters to which this order applies—
(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act.
(b) Appoint harbourmasters, and other officers and define or limit their powers and duties.
SCHEDULE
ALL that area of water enclosed by a line commencing at the waters edge adjacent to the south-western corner of the Borough of Kapiti, thence on a bearing of 333° true for a distance of 8.3 nautical miles, thence on a bearing of 035° true for a distance of 7.5 nautical miles, thence on a bearing of 153° true to the waters edge at the mouth of the Waikanae River as shown edged red on plan MD 16137 deposited in the office of the Secretary for Transport at Wellington.

EXPLANATORY NOTE
This note is not part of the order, but is intended to indicate the area subject to the order.
The area described in the Schedule to this order includes the waters adjacent to the Borough of Kapiti, between Kapiti Island and the mainland and the waters surrounding Kapiti Island.
Correcting Error of Description in Order in Council

PURSUANT to section 7 of the National Parks Act 1980 and section 25 (i) of the Acts Interpretation Act 1924, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council adding land to the Westland National Park made on the 21st day of June 1982 and published in the Gazette of 1982 at page 2008 by omitting the expression “223”, and substituting the expression “233”.

PURSUANT to section 47 of the Human Rights Commission Act 1977, His Excellency the Governor-General has been pleased to appoint
