FIRST SCHEDULE

FIRSTLY, all that area of water at the northern side of Lake Camp situated in Block VI, Tripp Survey District bounded to the west by a line commencing at a marker post situated at a point on the edge of the lake bearing 150° distant 52 metres from the south-eastern corner of the Clearwater Aquatic Clubhouse, thence out into the lake on a bearing of 090°, to a point 50 metres from the north shore of the lake, thence easterly and southerly 50 metres from the lakeshore to the eastern boundary, being a line commencing at a marker post situated at a point on the lake edge 50 metres west of a pine shelter belt, thence out into the lake on a bearing of 205° distant 50 metres, as more particularly shown marked red on plan MD 16091 deposited in the office of the Ministry of Transport at Wellington.

Secondly, all that area of water at the southern side of Lake Camp bounded to the west by a line commencing at a marker post situated at a point on the lakeshore bearing 160° distant 330 metres from the south-eastern corner of the Clearwater Aquatic Clubhouse, thence out into the lake on a bearing of 120° distant 50 metres, thence generally south-easterly 50 metres from the lakeshore to the eastern boundary, being a line commencing at a marker post on the lake-shore 720 metres south-east of the point of commencement, thence out into the lake on a bearing 040° distant 50 metres, as more particularly shown marked red on plan MD 16091 deposited in the office of the Ministry of Transport, Wellington.

SECOND SCHEDULE

  1. Notwithstanding any other provision of this notice, no person who is permitted by any such provision to propel or navigate a small craft at a speed through the water exceeding 5 knots shall do so in any manner that is likely to endanger or unduly annoy any person who is, in, on, or using the waters, or fishing, or undertaking any recreational activity in the vicinity of the small craft.

  2. All persons in charge of a vessel shall adhere to and keep the provisions of all Acts and regulations not specifically exempted by this notice.

  3. A suitable notice as may be approved by the Regional Marine Officer, Ministry of Transport, Christchurch, shall be erected at the sites deemed necessary by the Regional Marine Officer.

The Water Recreation (Lake Clearwater) Notice 1981

I, Robin Paul Taylor, Senior Executive Officer (Harbours and Foreshores), pursuant to the Water Recreation Regulations 1979* and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby give the following notice.

NOTICE

  1. (a) This notice may be cited as the Water Recreation (Lake Clearwater) Notice 1981.

(b) This notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the Gazette.

  1. Pursuant to regulation 18 and subject to the conditions set forth in the Third Schedule hereto, the area described in the First Schedule hereto shall be reserved for yachts, boats propelled by oars or paddles, and rafts.

  2. Subject to the conditions set forth in the Third Schedule hereto, regulations 7 (1) a, 7 (1) b and 7 (2) shall not apply to that area as specified in the Second Schedule hereto.

FIRST SCHEDULE

ALL the waters of Lake Clearwater as shown more particularly on MD 16092 deposited in the office of the Ministry of Transport, Wellington.

SECOND SCHEDULE

ALL the waters of Lake Clearwater excepting thereout that area within 50 metres of water's edge and those areas designated as being prohibited areas as shown more particularly on plan MD 16092 deposited in the office of the Ministry of Transport, Wellington.


THIRD SCHEDULE

  1. The Water Recreation (Port Fitzroy, Great Barrier Island) Notice 1981

I, Robin Paul Taylor, Senior Executive Officer (Harbours and Foreshores), pursuant to the Water Recreation Regulations 1979* and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby give the following notice.

NOTICE

  1. (a) This notice may be cited as the Water Recreation (Port Fitzroy, Great Barrier Island) Notice 1981.

(b) This notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the Gazette.

  1. Subject to the conditions set forth in the Second Schedule hereto, regulations 7 (1) a and b, 7 (2), 8 (1) a and b, and 8 (2) of the Water Recreation Regulations 1979 shall not apply to those areas as specified in the First Schedule.

FIRST SCHEDULE

ALL that area of water in Rarohara Bay, Port Fitzroy, Great Barrier Island, situated in Block II, Fitzroy Survey District, bounded by lines commencing at the point 36° 09′ 53.4″ South 175° 21′ 42.6″ East; thence south-westerly, bearing 211° 28′ true distance 550 m; thence north-easterly, bearing 31° 28′ true distance 45 m; thence north-westerly, bearing 301° 28′ true distance 45 m to the point of commencement.

SECOND SCHEDULE

The access lane shall be marked as follows:

  1. Two 2.5 m transit posts with a distance of not less than 3 m or more than 6 m between and painted with 300 mm bright orange and black bands shall be erected on land in line with the limiting line as defined in the First Schedule at bearing 211° 28′ true distance 550 m, the first post being sited at high-water mark.

  2. 2.5 m transit posts with a distance of not less than 3 m or more than 6 m between and painted with 300 mm bright orange and black bands shall be erected on land in line with the limiting line as defined in the First Schedule at bearing 211° 28′ true distance 45 m, the first post being sited at high-water mark.

  3. On each side of the transit posts sited on high-water mark there shall be a notice board measuring not less than 800 mm × 600 mm, painted bright orange with black lettering in the following form:

MOORING OF VESSELS AND BATHING PROHIBITED

  1. A set of 4 marker buoys shall be moored at equidistant points along that limiting line described in the First Schedule at bearing 211° 28′ true distance 550 m, the first buoy being located at the point 36° 09′ 53.4″ South 175° 21′ 42.6″ East, and the fourth buoy being located distance 550 m bearing 211° 28′ true from that point.

  2. A set of 4 marker buoys shall be moored at equidistant points along that limiting line described in the First Schedule
