Land Proclaimed as Road, Road Closed, Road Closed and Vested, Road Closed and Incorporated in a Deferred Payment Licence, Road Closed and Incorporated in an Adjoining Crown Lease, Land Taken, Land Resumed and Land Allocated in Blocks XXXIII, XXXIV, XXXVII, XXXVIII and XXXIX, Takitimu Survey District, Wallace County

PURSUANT to section 29 of the Public Works Amendment Act 1948, the Minister of Works and Development hereby proclaims as road the land described in the First Schedule hereto, which land shall vest in the Wallace County Council, hereby proclaims that the road described in the Second Schedule hereto is hereby closed, hereby takes the land described in the Third Schedule hereto for the purposes of subsection (6) of the said section 29 and hereby allocates the land described in the Fifth Schedule hereto for the purposes of subsection (6) of the said section 29 and declares that the road first described in the Second Schedule hereto when so closed, shall be dealt with as Crown Land under the Land Act 1948, the road secondly, fifthly and sixthly, described in the Second Schedule hereto when so closed, together with the land described in the Fifth Schedule hereto when so allocated, shall vest in Arnold John Gray and Russell Ian Gray, both of Blackmount, farmers, as tenants in common in equal shares subject to mortgages No. 002991.3, 002991.4, 032578.1, 046356.2, 046356.3, 002991.5 and 046356.4, the road thirdly and fourthly, described in the Second Schedule hereto, when so closed, shall vest in Graham Douglas Sim of Blackmount, farmer (half-share) and the said Graham Douglas Sim and Dorothy Lynne Sim, his wife (half-share jointly inter se) subject to mortgages No. 023736.1, 040883.2 and 044162.1, the road seventhly described in the Second Schedule hereto, when so closed, shall be incorporated in Crown Lease S 38 recorded in certificate of title No. A2/1031 held from Her Majesty The Queen by Hugh Royds Irving of Otatau, farmer, subject to mortgage No. 223152, certificate No. 257683 and agreement No. 058712.1, the road eighthly described in the Second Schedule hereto, when so closed, together with the land in the Third Schedule hereto, when so taken and the land in the Fourth Schedule hereto, when so resumed, shall be incorporated in deferred payment licence No. DPF 171 recorded in certificate of title, Volume 235, folio 96 held by Hugh Royds Irving of Otatau, farmer, subject to notice No. 183067, mortgages No. 021208.2, 217601, agreement No. 236106, certificate No. 257683, mortgages No. 000503.1, 05644.2 and agreement No. 058712.1, the road ninthly described in the Second Schedule hereto when so closed, shall vest in The New Zealand Insurance Company Limited, a duly incorporated company having its registered office at Auckland subject to mortgage No. 015113.1, and the road tenthly described in the Second Schedule hereto when so closed, shall vest in Peter Charles Gow, of Blackmount, farmer, subject to mortgages No. 001763.2, 058573.1 and 055062.4.
