The Water Recreation (Waikato River, Cambridge to Ngaruawahia) Notice 1981
I, Robin Paul Taylor, Senior Executive Officer (Harbours and Foreshores), pursuant to the Water Recreation Regulations 1979 and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby give the following notice:

(a) This notice may be cited as the Water Recreation (Waikato River, Cambridge to Ngaruawahia) Notice 1981.
(b) The notice shall come into force 14 days after publication in the New Zealand Gazette and shall remain in force until revoked by further notice in the Gazette. -
Subject to the conditions set forth in the Third Schedule hereto, regulations 7 (1) (a) and (b) and 7 (2) of the Water Recreation Regulations 1979, shall not apply to the area as specified in the First Schedule hereto.

Subject to the conditions set forth in the Third Schedule hereto, regulations 8 (1) (a) and (b) and 8 (2) of the Water Recreation Regulations 1979, shall not apply to the area as specified in the Second Schedule hereto.
FIRST SCHEDULE
ALL that area of water in the Waikato River extending from the Ferguson Bridge, Cambridge, downstream to where the extension of the northern boundary of Lake Road, Horotiu, crosses the Waikato River, as marked by notice boards, excepting thereout that area of water 200 metres either side of the Grantham Boat Ramp, Hamilton, as marked by notice boards. The area is more particularly shown on plan M.D. 16053, deposited in the office of the Ministry of Transport, Wellington.
SECOND SCHEDULE
ALL that area of water in the Waikato River extending from the Ferguson Bridge, Cambridge, downstream to where the extension of the northern boundary of Lake Road, Horotiu crosses the Waikato River, as marked by notice boards excepting thereout that area of water extending from the extension of Wellington Street, Hamilton, into the river downstream where the westward extension of Wymer Terrace, Hamilton, crosses the Waikato River as marked by notice boards. The area is more particularly shown on plan M.D. 16053, deposited in the office of the Ministry of Transport, Wellington.
THIRD SCHEDULE

Suitable notices shall be erected at the limits of the areas described in the First and Second Schedules hereto, setting out the extent of the exemptions.

There shall be erected on both banks of the Waikato River at each point described in the First and Second Schedules hereto, a conspicuous marker post painted with 300 mm bright orange and black bands as may be approved by the Regional Marine Officer, Ministry of Transport, Auckland.

Any person in charge of a vessel when proceeding at a speed greater than 5 knots within the areas described in the foregoing Schedules to this notice shall not approach, pass or carry out any manoeuvres that are likely to threaten the safety of or cause undue annoyance to any other person using the water for fishing, boating, swimming, or other recreational pursuits.

The Collision Regulations Order 1976 must be observed.

Commerce Act 1975
By letter dated 23 December 1980, the Minister of Trade and Industry has required the Commerce Commission to inquire, pursuant to section 82 (7) of the Act, and report to him on the advisability of removing from the Positive List of Controlled Goods and Services 1977 intoxicating liquor. (More fully described in the appendix at the foot of this notice.) A copy of the full text of the Minister's letter is available on request to the Commission.
The Minister has asked that the report of the Commission cover in particular (with reasons):
(a) Whether price control in terms of section 82 of the Act should be continued on intoxicating liquor as defined in the appendix or on any part thereof; or
(b) Whether price restraint in terms of section 83 would be warranted if price control were removed; or
(c) Such other recommendations as the Commission thinks fit.
The Minister has asked that this report be sent to him by 30 September 1981.
The Commission will accordingly inquire into this matter. At this stage it requests that any persons or organisations, who wish to apply to be a party, in terms of section 14 of the Act, apply to the Executive Officer of the Commission in writing by Friday, 27 February 1981. It would assist the Commission if all applicants explained the nature of their interest and indicated whether they support or are opposed to the possible removal of price control.
If necessary, it is proposed that a party hearing to consider applications received will be held on Thursday, 12 March 1981, at 10 a.m. at the Commission's hearing room, Sixth Floor, Chase NBA House, 163 The Terrace, Wellington.
The date by which submissions from the parties will be required and the dates on which the main hearing will be held have yet to be decided.
APPENDIX
INTOXICATING LIQUOR
All intoxicating liquor sold in public bars of hotels, taverns, or other premises licensed under the Sale of Liquor Act 1962, or deemed to be licensed under that Act pursuant to the Licensing Trusts Act 1949, or the Masterton Licensing Trust Act 1947, or the Invercargill Licensing Trust Act 1950; and
All draught beer in flagons, and bottled beer in bottles containing not less than 745 millilitres, sold for consumption off the premises in hotels, taverns, or other premises licensed under the Sale of Liquor Act 1962, or deemed to be licensed under that Act pursuant to the Licensing Trusts Act 1949, or the Masterton Licensing Trust Act 1947, or the Invercargill Licensing Trust Act 1950.
