Price Order No. 225 (Cream Delivery Margins and Allowances)
I, Desmond James Gasson, being duly authorised by the Secretary of Trade and Industry in this behalf, do hereby make the following price order in accordance with the provisions of section 89 of the Commerce Act 1975, and section 25 (3) of the Milk Act 1967 (as amended by section 6 of the Milk Amendment Act 1980).

This order may be cited as Price Order No. 225.

In this order, unless the context otherwise requires:
"The Act", means the Milk Act 1967:
"Commercial-user sale", in relation to any cream, means any sale of that cream (other than a shop-dairy sale) to any person for resale, for human consumption on premises occupied by him (whether in the form in which it was sold to him or not, and whether separately or in combination with any other substance);
"Consumer sale", in relation to any cream, means any sale of that cream for human consumption (other than a shop-dairy sale) for purposes other than resale:
"Cream", has the same meaning as in the Food and Drug Regulations 1973:
"Milk District", means a milk district constituted and declared as a milk district under the Act:
"Shop-dairy occupier", means a person who is the occupier of a shop in which he sells cream in the form in which it was sold to him, for human use or consumption off the premises of that shop:
"Shop-dairy sale", means the standard rates of margins and allowances payable in respect of the delivery of cream specified in the Schedule hereto:
"Vendor", means a milk vendor within the meaning of the Act.

This notice applies to all cream sold for human consumption in any milk district.

The standard rates specified in the Schedule hereto are hereby fixed with effect from and including the 1st day of October 1981.

No additional charge shall be made for the exchange or other handling of bottles provided for the delivery of cream, or for any other service supplied in respect of such bottles or their contents.
SCHEDULE
STANDARD rates of margins and allowances payable in respect of the delivery of cream.
Nature of Service Margin or allowance at the rate of cents per litre
- Delivery in respect of shop-dairy sale in any quantity 13
- Delivery in respect of commercial-user sale or consumer sale in quantities of—
(1) Less than 2.4 litres per delivery 38
(2) 2.4 litres and over per delivery 13

"Cream", has the same meaning as in the Food and Drug Regulations 1973:
"Milk", means milk within the meaning of the Act; but does not include cream or goat's milk:
"Shop-dairy occupier", means a person who is the occupier of a shop in which he sells milk and/or cream in the form in which it was sold to him, for human use or consumption off the premises of that shop:
"Retail sale", in relation to any milk or cream, means the sale of that milk or cream by a shop-dairy occupier:
"Standard rates", means the standard rates of margins payable in respect to the retail sale of milk and cream specified in the Schedule hereto.

The Milk Price Notice 1981, No. 2684; Ag. 4/51/12/5
PURSUANT to section 25 of the Milk Act 1967, the Minister of Agriculture and Fisheries hereby gives the following notice.
N O T I C E
- Title and commencement—(1) This notice may be cited as the Milk Price Notice 1981, and shall be read together with and deemed part of the Milk Price Notice 1980* (hereinafter referred to as the principle notice).
(2) This notice shall come into force on the 1st day of October 1981.

Maximum price for milk sold to consumers and commercial users—The principle notice is hereby amended by revoking the First Schedule, and substituting the First Schedule set out in the Schedule to this notice.

Maximum price at which milk may otherwise be sold—The principle notice is hereby amended by revoking the Second Schedule, and substituting the Second Schedule set out in the Schedule to this notice.

Revocation—The Milk Price Notice 1980, Amendment No. 3, is hereby consequently revoked.

Notice is hereby given that the Commerce Commission has, pursuant to condition (ii) of Decision No. 30, approved a new scale of fees and charges to be issued by the New Zealand Woolbrokers Association under Collective Pricing Agreement Registration No. 5, dated 22 March 1972.
The new scale of fees and charges approved by the Commission are available for inspection at the Commission's office, Sixth Floor, Chase-NBA House, 163 The Terrace, Wellington.
