The Wanganui Harbour Board Land Sale Approval Notice 1980

WHEREAS:

(1) The Wanganui Harbour Board (called “The Board”) was registered as the proprietor of an estate in fee simple in the land described in the Schedule hereto (called “The Land”).

(2) The Board has sold the land to the Wanganui City Council.

(3) Section 143C of the Harbours Act 1950 (called “The Act”), provides that subject to section 143A of the Act, a harbour board may sell any land vested in it by private treaty, with the specific approval of the Minister of Transport, provided that that power may not be exercised in any case where the land to be sold is:

(a) foreshore or land described in section 150 of the Act, or

(b) public reserve within the meaning of the Reserves Act 1977, or

(c) held by a harbour board on trust for a specific purpose (not being an endowment for the general purposes of the harbour district and not being subject to any express prohibition or restriction as to sale).

(4) The land does not come within any of the categories referred to in the proviso to clause 3 as hereinbefore stated.

(5) Section 143A of the Act provides that the powers set out in section 143C of the Act may be exercised by a harbour board only with the approval of the Minister of Transport (called “The Minister”), who may give his approval subject to such conditions as he thinks fit, provided that the Minister shall not give his approval as aforesaid without the concurrence of the Minister of Finance.

(6) The Minister did not approve of the sale as aforesaid or of a sale by private treaty.

(7) Section 265 of the Act provides that in any case where anything has been done by a harbour board without the harbour board having previously obtained the proper authority of the Minister, the Minister may by notice in the Gazette validate anything so irregularly or incorrectly done.

PURSUANT to sections 265, 143A, and 143C of the Act, I, Colin Alexander McLachlan, the Minister of Transport, hereby approve of the sale by private treaty of the land by the Board to the Council, and declare that the land has been validly sold and conveyed to the Council.


SCHEDULE

ALL that parcel of land in the Wellington Land Registration District containing 39.8402 hectares, be the same a little more or less, situate in the City of Wanganui being part Section 227, Right Bank Wanganui River, part Lots 15, 16, 23, and 24, on Deposited Plan 1374, and Part Lot 1, on Deposited Plan 41798, and being all the land described in certificate of title, Volume 20A, folio 442.

The Traffic (Rotorua District) Notice No. 2, 1980

PURSUANT to the Transport Act 1962, the Minister of Transport hereby gives the following notice.


NOTICE

  1. This notice may be cited as the Traffic (Rotorua District) Notice No. 2, 1980.

  2. The area specified in the First Schedule hereto (with the exception of the roads specified in the Second Schedule hereto) is hereby declared to be a closely populated locality for the purposes of section 52 of the Transport Act 1962.

  3. The roads specified in the Second Schedule hereto are excluded from the limitation as to speed imposed by section 52 of the Transport Act 1962.

  4. The roads specified in the Third Schedule hereto are hereby declared to be 70 kilometres an hour speed limit areas pursuant to regulation 21 (2) of the Traffic Regulations 1976*.

  5. The Traffic (Rotorua City and Rotorua County) Notice No. 1, 1976, dated the 19th day of December 1975†, issued pursuant to section 52 of the Transport Act 1962, and regulation 27A of the Traffic Regulations 1956, is hereby revoked.


FIRST SCHEDULE

SITUATED within Rotorua District at Rotorua City:

ALL that area at Rotorua with the exception of the roads specified in the Second and Third Schedules hereto, bounded by a line commencing at a point on the western side of the No. 5 State Highway (Tirau-Napier via Rotorua and Taupo), where the said State Highway intersects with Old Taupo Road at its southern end; thence due east by a right line to the western bank of the Puarenga Stream; thence north-easterly, generally, along the western bank of the Puarenga Stream to the Shoreline of Lake Rotorua; thence north-westerly, generally, along the said shoreline to a point 1 kilometre measured northerly, generally, from Kawaha Point; thence south-westerly, generally, by a right line to a point on the western side of the No. 5 State Highway (Tirau-Napier via Rotorua and Taupo), 40 metres measured northerly generally, along the said State Highway from Barnard Road; thence south-westerly, generally, by a right line to the eastern side of Mountain Road; thence south-westerly, generally, along the eastern side of Mountain Road to Clayton Road; thence across Mountain Road at right angles from its eastern side to its western side; thence westerly, generally, along the northern side of Clayton Road to a point opposite the eastern side of Pukehangi Road; thence south-easterly, generally, along the said road from Malfroy Road; thence across Pukehangi Road at right angles from its north-eastern side to its south-western side; thence south-easterly, generally, along the south-western side of Pukehangi Road to Matipo Avenue; thence south-westerly and south-easterly, generally, along the western side of Matipo to its southern end; thence south-easterly, generally, by a right line to the southern end of Utuhina Road; thence easterly, generally, by a right line to the southern end of Tihi Road; thence easterly, generally, to the southern end of Otonga Road; thence easterly, generally, by a right line to the commencing point.


SECOND SCHEDULE

SITUATED within Rotorua District at Rotorua City:

No. 5 State Highway: (Tirau-Napier via Rotorua and Taupo) from a point 100 metres measured southerly, generally, from the southern end of Old Taupo Road to a point 460 metres measured north-easterly, generally, along the said State Highway from the southern end of Old Taupo Road.

No. 30 State Highway: (Te Kuiti-Whakatane via Atiamuri) from the Puarenga Stream to a point 240 metres measured south-easterly, generally, along the said State Highway from Ti Street.

Sala Street: from the No. 30 State Highway (Te Kuiti-Whakatane via Atiamuri) to a point 60 metres measured easterly, generally, along the said street from Tryon Street.


THIRD SCHEDULE

SITUATED within Rotorua District at Rotorua City:

No. 30 State Highway: (Te Kuiti-Whakatane via Atiamuri) from the Puarenga Stream to a point 240 metres measured south-easterly, generally, along the said State Highway from Ti Street.
