PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby directs the sale of the land
described in the Schedule hereto, such land being no longer
required for the purpose for which it was acquired.

Lakes District Foreshore, Lake Shore, Lake Bed, River Bed,
and Waters Control Order 1980

ORDER IN COUNCIL
At the Government Buildings at Wellington this 13th day of

THE RIGHT HON. D. MACINTYRE PRESIDING IN COUNCIL
PURSUANT to sections 8A and 165 of the Harbours Act 1950,
His Excellency the Governor-General acting by and with the
advice and consent of the Executive Council and on the joint
request of the Lake County Council, Queenstown Borough
Council and Arrowtown Borough Council, hereby makes the
following order:
O R D E R
- (a) This order may be cited as the Lakes District Fore-
shore, Lake Shore, Lake Bed, River Bed and Waters Control
Order 1980.
(b) This order shall come into force on the date of its
publication in the Gazette.
- In this order:
“The Act” means the Harbours Act 1950;
“The Councils” or “Councils” means the Lake County
Council, Queenstown Borough Council, and Arrow-
town Borough Council, either individually or collec-
tively;
“Foreshore” means such parts of the bed, shore or banks
of a tidal water as are covered and uncovered by the
flow and ebb of the tide at ordinary spring tides;
“Lakes District Waterways Authority” or “Authority”
means the representatives of the Councils as con-
stituted by paragraph 1 of the Second Schedule to
this order for the purposes of carrying out the powers
and duties granted under this order;
“Lake Shore, Lake Bed, River Bed” means those areas
described in the First Schedule to this order;
“Minister” means the Minister of Transport; and includes
any officer or, person or authority acting by or under
the direction of the Minister.
- There is hereby granted to the authority for a period
of 21 years from the commencement of this order, subject
to the provisions of sections 8A and 165 of the Act and to
the conditions specified in the Second Schedule to this order—
(a) Control of the foreshore, lake shore, lake bed and
river bed as described in the First Schedule to this
order.
(b) Control of the waters as specified in the First Schedule
to this order.

The Order in Council dated 8 February 1965* granting
control of the lake shore described in the First Schedule to
that order to the Queenstown Borough Council is hereby
revoked. -
The Order in Council dated 4 June 1978† granting con-
trol of the lake shore described in the First Schedule to that
order to the Lake County Council is hereby revoked. -
The Order in Council dated 20 August 1973‡ granting
control of the waters described in the First Schedule to that
order to the Lake County Council is hereby revoked.
FIRST SCHEDULE
ALL that area of foreshore, lake shore, lake bed, river bed
and waters within the boundaries of the County of Lake
excluding therefrom those areas within a national park but
including the foreshore of Big Bay and the waters within
200 metres of the waters edge at Big Bay as shown more
particularly coloured red on plan M.D. 16027 and deposited
in the office of the Ministry of Transport at Wellington.
SECOND SCHEDULE
-
The Councils shall be represented on the Committee
known as the Lakes District Waterways Authority as follows:
Four to be appointed by the Lake County Council;
Two to be appointed by the Queenstown Borough
Council;
One to be appointed by the Arrowtown Borough Council. -
(a) All money received by the Authority in respect of
the areas described in the First Schedule hereto in the exer-
cise or performance of these powers, functions, duties and
authorities conferred by this order shall, subject to the
deduction of any expenditure incurred by the Authority in
the exercise or performance of these powers, functions, duties
and authorities be applied to the construction, repair or
improvement of the works or in respect of the areas described
in the First Schedule hereto and not otherwise.
(b) Subclause (a) of this clause shall apply with respect
to money received by the Authority after the commence-
ment of this order and any bylaw made pursuant to clause
(8) of the Second Schedule to this order levied either before
or after the commencement of this order, in respect of the
areas described in the First Schedule hereto.
- Her Majesty or the Governor-General and all officers in
the Government service acting in the execution of their duties
shall at all times have free ingress, passage, and egress into,
