Decision of the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications:

  4. Sex Encyclopaedia published by H. H. Publications.
  5. Sex in Marriage No. 10 published by Toni Books.

BEFORE THE INDECENT PUBLICATIONS TRIBUNAL

Hearing: 13 June 1979.

Appearances: Mr. P. E. Leloir for Comptroller of Customs.

Written submissions from the importers were received and considered.

Decision

These five books are submitted to the Tribunal by the Comptroller of Customs. Each is a form of sex manual which comprise photographs of sexual intercourse together with a text which more or less complements the photography.

While there are variations in presentation and impact among the books they may properly be considered together as being generally restrained and natural. The Tribunal does not perceive in these books a prurient or dishonest purpose. The dominant effect is rather a sensible and serious presentation of modes of sexual behaviour.

In submissions to us reference was made to decisions 432–435 made in March 1972. While we adhere to the general principles there set out, the Tribunal considers that there has been some change in the standards of community opinion since then. While some age restriction is appropriate there is not, in our opinion, any need in respect of these books to distinguish among them.

The Tribunal classifies each book as indecent in the hands of persons under the age of 16 years.

Decision

Books numbered 2, 3, and 4, are each a collection of anecdotes, and some limericks, which are largely puerile and harmless—none of the books has any literary merit, the collection of so-called jokes are trivial though at times a little crude. However the Tribunal does not consider them to be injurious and therefore classifies them as not indecent.

More Rugby Songs

This book of bawdy verse has nothing to commend it. The contents are crude and indecent to say the least and should not be readily available to younger persons.

The Tribunal has no hesitation in classifying this book as indecent in the hands of persons under the age of 16.
