Declaring Land in Roadways Laid Out in Block VI, Motatau
Survey District, Bay of Islands County, to be Road

A PROCLAMATION
PURSUANT to section 421 of the Maori Affairs Act 1953, I,
The Right Honourable Sir Keith Jacka Holyoake, the
Governor-General of New Zealand, hereby proclaim and
declare the land described in the Schedule hereto and
comprised in roadways laid out by the Maori Land Court
by an order dated the 23rd day of November 1970, to be
road, and to be vested in the Bay of Islands County Council.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL those pieces of land situated in Block VI, Motatau
Survey District, described as follows:

As shown on plan S.O. 47821, lodged in the office of the
Chief Surveyor at Auckland, and thereon coloured blue.
Given under the hand of His Excellency the Governor-

Revocation of Reclamation Authority—Sunshine Bay,
Wellington Harbour

ORDER IN COUNCIL
At the Government House at Wellington this 5th day of
June 1979
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 175 (4) of the Harbours Act 1950, His
Excellency the Governor-General, acting with the advice and
consent of the Executive Council, hereby amends the Order
in Council* authorising the Wellington Harbour Board to
reclaim 1264.4 square metres of land (1 rood and 10 perches),
more or less, in Sunshine Bay, Wellington Harbour, as shown
on plan M.D. 10980, by revoking the authority to reclaim
that portion of land as shown on M.D. 10980 which is
outside the line of mean high water shown on plan S.O.
28357 (M.D. 15943). This is the area of approximately
252.92 metres square (10 perches) shown in red on plan
M.D. 15942. The said plans M.D. 10980, M.D. 15942, and
M.D. 15932 are held in the Ministry of Transport, Head
Office at Wellington.

Tauranga County - Mount Maunganui Borough
Boundary Alteration Order 1979

ORDER IN COUNCIL
At the Government Buildings at Wellington this 25th day of
June 1979
Present:
THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL
PURSUANT to the Local Government Act 1974, His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby makes the following
order.
ORDER
- Title and commencement—(1) This order may be cited as
the Tauranga County - Mount Maunganui Borough Boundary
Alteration Order 1979.
(2) This order shall come into force on the 30th day of
June 1979.

Boundaries of Tauranga County and Mount Maunganui
Borough altered—The boundaries of the County of Tauranga
and the Borough of Mount Maunganui shall be altered by
excluding from the district of the County of Tauranga and
including in the district of the Borough of Mount Maunganui
the area described in the schedule to this order. -
Transitional provisions—The Mount Maunganui Borough
Council, in respect of the area described in the schedule to
this order:
(a) shall have and may exercise and be responsible for all
the powers, duties, acts of authority, and functions
which were previously exercised, or which would
have been so exercised, by the Tauranga County
Council;
(b) shall have and may exercise and be responsible for all
liabilities, obligations, engagements, and contracts
which previously were, or which would have been,
the responsibility of the Tauranga County Council;
(c) shall have and may exercise and be responsible for all
actions, suits, and proceedings pending by or against,
or which would have been the responsibility of, the
Tauranga County Council;
(d) shall succeed to the bylaws which are in force in that
area and which are applicable to the altered circumstances of the Mount Maunganui Borough Council;
and, until revoked or altered by the Mount Maunganui Borough Council, every such bylaw shall remain
in force in the area in which it was in force immediately before the alteration of boundaries; and every
bylaw which cannot be restricted to that area shall
be deemed inapplicable and revoked in respect of
that area by the alteration of boundaries;
(e) shall succeed to all rates or levies and other money
payable to the Tauranga County Council;
(f) shall succeed to the valuation rolls, electoral rolls, and
rate records in force in that area, which shall remain
in force until such rolls or records are made for it;
and until that time Part IX of the Rating Act 1967
shall apply as if the district in which the area was
included was the district of a special purpose
authority and the areas from which it was formed
were constituent districts.

Mayor and Principal Officer—The mayor and principal
officer of the Mount Maunganui Borough Council shall
exercise the duties, powers, and functions of the chairman
and principal officer of the Tauranga County Council in
respect of the area described in the schedule to this order. -
Creditors—Subject to section 37P of the Local Government Act 1974, the rights or interests of creditors of any
district affected by the order shall not be affected. -
Vesting of land formerly vested in the Corporation of
the District of Tauranga County—The corporation of the
district of Mount Maunganui Borough shall, in respect of
the area described in the schedule to this order, have vested
in it, subject to all existing encumbrances, all land situated in
that area that is currently vested in the corporation of the
district of Tauranga County. -
Rating—The system of rating in the area described in
the schedule to this order shall continue to be the land value
system.
SCHEDULE
ALL that area in the South Auckland Land District, Tauranga
County, situated in the Tauranga and Te Tumu Survey
Districts, containing 500 hectares, more or less, bounded by
a line commencing at the intersection of the northernmost
point of Papamoa No. 2 Section 10A2C4 Block, and the mean
high-water mark of the sea, situated in Block XI, Tauranga
Survey District; and proceeding generally south-easterly along
the mean high-water mark of that sea coast to a point on
the production of the north-western boundary of Section 53,
Block I, Te Tumu Survey District; and proceeding generally
south-westerly along that production and along that boundary
to the northern side of Papamoa Beach Road; thence by
right line across that road to and along the north-western
boundary of part Papamoa No. 2 Section 7A Block, to and
along its production across State Highway No. 2 to the
southern side of the East Coast Main Trunk Railway; thence
south-easterly along that side to an adopted peg 253° 11'
13.43 metres (66.76 links) from an old peg, shown on M.L. Plan
10594; thence by right line across the East Coast Main Trunk
Railway to an adopted roadside peg 96° 15' 137.42 metres
(683.1 links) from adopted peg XXXVII, and 276° 15' 70.27
metres (349.3 links) from an old peg, shown on M.L. Plan
10594; thence generally westerly along the southern side of
