Decision of the Broadcasting Tribunal
IN the matter of the Broadcasting Act 1976, and in the matter of a complaint by Chace Chenoweth Werry, pursuant to section 67 (1) (b).

DECISION
The Complaint—
Mr C. C. Werry, of Waipukurau, has complained about a 20-second film sponsored on TV Two by Leopard Breweries Ltd.
By the device of a three stage zoom the viewer is rapidly transported from a high angle view of broad coastline to a close up of rubbish on the beach with a clean Leopard Export beer can prominently exposed. The sound track runs, “Our beautiful coastline—Yours to enjoy—don’t throw it away.”
A contrasting shot in white animated line on black shows a kiwi dropping an outline can into a litter basket. The words, “Be a tidy Kiwi”
synchronise with this. Then follows a white caption saying, “Only lazy people litter.”
The caption is then supplemented with a coloured Leopard logo and a line of type, “A Leopard Breweries Community Service.”
Decision—
- The Tribunal is satisfied that the film constitutes an advertisement for the Leopard Export brand of beer.
The advertisement rules which applied at the time of the complaint prohibit any advertisement which, directly or by implication, is designed to promote the general consumption of alcoholic beverages. The rule sets out the conditions under which advertisements for alcohol may be made and broadcast. Advertisements must not use brand names as such.
The advertisement clearly falls within the definition of an advertisement under the rules and is clearly in breach of those rules.
- On 1 July, Broadcasting Regulations 1977, Amendment No. 3, imposed in every warrant a condition “that the holder of the warrant shall not broadcast any programme that promotes the consumption of liquor, being a programme”
