  1. Representation on district council—For a period of not less than 5 years from the commencement of this order the district council shall comprise 9 councillors and the district shall be divided into 5 ridings having representation on the district council as follows:

Argyll Riding—comprising the area of the Waipawa Riding of the former County of Waipawa (2 councillors);

Takapau Riding—comprising the area of the Takapau Riding of the former County of Waipawa (1 councillor);

Onga Onga Riding—comprising the area of the Onga Onga Riding of the former County of Waipawa (2 councillors);

Clinton Riding—comprising the area of the Clinton Riding of the former County of Waipawa (1 councillor);

Waipawa Riding—comprising the area of the former Borough of Waipawa (3 councillors).

  1. Transitional members of district council—Notwithstanding the provisions of clause 5 of this order, until the members of the district council, to be elected at the next triennial general election of members of local authorities (to be held on the 2nd Saturday in October in the year 1980), come into office, the district council shall consist of 12 members of whom—

(a) Nine shall be the persons who held office as Councillors of the County of Waipawa immediately before the commencement of this order; and

(b) Three shall be persons who held office as Councillors of the Borough of Waipawa and who, before the commencement of this order, were elected as members of the district council by the Waipawa Borough Council.

  1. First meeting of district council—The first meeting of the district council shall be convened by the person holding the office of County Clerk of the Waipawa County Council immediately before the commencement of this order, and at that meeting the district council shall elect one of its members to be the Chairman of the district council.

  2. Waipawa community—The area of the Borough of Waipawa existing at the commencement of this order is hereby constituted a community to be known as the Waipawa Community.

  3. Waipawa District Community Council—A district community council to be known as the Waipawa District Community Council is hereby established for the Waipawa Community.

  4. Membership of Waipawa District Community Council—The Waipawa District Community Council shall consist of 7 members.

  5. Transitional membership of Waipawa District Community Council—Notwithstanding the provisions of clause 10 of this order, until the members of the Waipawa District Community Council, to be elected at the next triennial election of members of local authorities (to be held on the 2nd Saturday in October in the year 1980), come into office, the members of that Council shall comprise the person who held office as the Mayor and the persons who held office as the Councillors of the Borough of Waipawa immediately before the commencement of this order and the Council so comprised shall elect a Chairman from among its members at its first meeting.

  6. Attendance at official functions within Waipawa community—The district council may appoint a councillor or councillors to officiate at functions within the Waipawa community which were formerly attended by the Mayor of Waipawa.

  7. Community and community council of Takapau to endure—The community and community council of Takapau shall endure as if constituted by the district council.

  8. Counties Act 1956 applied—Except as otherwise provided in this order, the Counties Act 1956 shall apply to the district as if it were a county and to the district council as if it were a county council.

  9. District to be county and district council to be county council—For the purposes of any enactment other than the Counties Act 1956, the district shall be a county and the district council shall be a county council.

  10. Records—All the valuation rolls, electors’ lists, electors’ rolls, and rate records in force in the districts of the uniting authorities immediately before the commencement of this order shall be deemed to be the valuation rolls, electors’ lists, electors’ rolls, and rate records of the district until new valuation rolls, electors’ lists, electors’ rolls, and rate records are completed for the district.

  11. Rating—The system of rating within the district shall be the land value system.

  12. Finance generally—(1) Except as otherwise provided herein, the accounts of the district council shall be kept in accordance with the provisions of the Local Government Accounting Regulations 1974.

(2) The opening balance of the Waipawa Community Account shall be the closing balances of the General and Separate Rates and General Appropriation Accounts of the former Waipawa Borough Council on the commencement of this order.

(3) All other administrative accounts, works and services accounts and special fund accounts of the uniting authorities at the date of union shall be merged to operate as accounts of the district council:

Provided that all special funds shall be expended only for the purposes for which they were set aside and for the benefit only of the area from which they originated.

  1. Petroleum Tax—For the purposes of the Local Authorities (Petroleum Tax) Act 1970, the district council is hereby declared to be the successor of the uniting authorities.

  2. General transitional provisions—(1) Except as otherwise provided in this scheme the provisions of section 10 of the Counties Act 1956 (which relates to the succession to assets, liabilities, engagements, and bylaws of united counties) shall apply as if the districts of both the uniting authorities were counties.

(2) All property, real and personal, vested in the uniting authorities is hereby vested, subject to all existing encumbrances, in the district council.

  1. District planning schemes—The district planning schemes, scheme statements, and codes of ordinances in force in the districts of the uniting authorities immediately before the commencement of this order shall be deemed to be the district planning scheme, scheme statement, and code of ordinances of the district council; and the district council shall not be required forthwith to prepare a new district planning scheme for the whole of the district.

  2. Date of union for accounting purposes—For accounting and other financial purposes the union shall, subject to clause 18 of this order, be deemed to have taken place on the 1st day of April 1978.

  3. Revocation—The Order in Council which purports to effect the union of the County of Waipawa and the Borough of Waipawa (which Order in Council was made on the 28th day of November 1977 and was published in the Gazette of the 1st day of December 1977 at p. 3140), but which omits matters that are material to the final scheme that it purports to implement, is hereby revoked.

Appointment of Member of Licensing Committee

PURSUANT to section 32 of the Sale of Liquor Act 1962, His Excellency the Governor-General has been pleased to appoint Walter Keith Leslie Dougall, Esquire,

Stipendiary Magistrate of Napier, to be a member and chairman of the Hawke’s Bay Licensing Committee vice William Arthur Harlow, Stipendiary Magistrate, retired.

Appointment of Member of Licensing Committee

PURSUANT to section 32 of the Sale of Liquor Act 1962, His Excellency the Governor-General has been pleased to appoint John Kenneth Patterson,

Stipendiary Magistrate of Lower Hutt, to be a member and chairman of the Wairarapa Licensing Committee vice John Francis Keane, Stipendiary Magistrate, deceased.
