Notice of Acquisition of Public Reserve by the Crown

Pursuant to the Reserves and Domains Act 1953, notice is hereby given that the land, described in the Schedule hereto, has been acquired as a reserve for recreation purposes, subject to the provisions of Part II of the said Act.

OTARA 3A1 Block situated in Block II, Whangaruru Survey District: area, 3.9009 hectares, more or less. All certificate of title, No. 24B/29, of the North Auckland Land Registry (M.L. Plan 14792).

Motor Launch (Lake Wakatipu) Notice 1978—Lake County Council

Pursuant to the Motor Launch Regulations 1962* I, Owen John Conway, of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport hereby give the following notice:

  1. (a) This notice may be cited as the Motor Launch (Lake Wakatipu) Notice 1978.
    (b) This notice shall come into force on the date of its publication in the Gazette, and shall remain in force until revoked by further notice in the Gazette.

  2. Subject to the condition set forth in the Third Schedule hereto, Regulations 11 and 12 of the Motor Launch Regulations 1962, shall not apply with respect to the area described in the First Schedule hereto.

  3. The area described in the Second Schedule hereto shall be an access lane.

  4. Notice is hereby given that the Motor Launch (Lake Wakatipu) Notice 1978—Lake County Council**, is hereby revoked.

FIRST SCHEDULE

All that area of Lake Wakatipu at Kingston, within 200 metres of the water's edge, bounded to the south-east by a line at right angles to the water's edge at mean lake level, commencing at a position at that level in line with the west side of the north end of Cambridge Street, and bounded to the north-west by a similar line being an extension of the north-west boundary of Lot 22, Section 5, Block I, Kingston Survey District.

SECOND SCHEDULE

All that area of water extending out into Lake Wakatipu at Kingston, and bounded on the sides by parallel lines 121 metres apart, the north-west boundary being contiguous to the south-east boundary of the area described in the First Schedule to this notice, and the south-east commencing at a point on the water's edge at mean lake level at a position at that level in line with the west side of the north end of Oxford Street.

THIRD SCHEDULE

  1. No person shall propel or navigate a powered vessel at a proper speed greater than 5 miles per hour within the area described in the First Schedule hereto when
    (a) within 100 feet of any vessel; or
    (b) within 100 feet of any person in the water, or bathing, or fishing.

  2. The area of water described in the First Schedule hereto shall be shown cross-hatched on a plan of the lake on a scale not less than 100 m to 25.4 mm, which shall be displayed on the lower portion of a notice board measuring not less than 800 mm by 600 mm painted bright orange with black lettering, which notice board shall be erected at each place where boats are normally launched, and on the lakeshore at the north-west boundary of the area.

  3. The upper and middle portion of the aforesaid notice board shall contain the following notice:

There is no speed restriction for motor launches and waterskiers using the area shown cross-hatched on the plan below, subject to the following conditions:

No person shall propel or navigate a powered vessel at a proper speed greater than 5 miles per hour when
(a) within 100 feet of any other vessel; or
(b) within 100 feet of any person in the water, or bathing, or fishing.

  1. Two 0.5 m transit posts with a distance of not less than 3 m or more than 6 m between, and painted with 300 mm bright orange and black bands, shall be erected on land in line with each side of access lane, the first post being sited on the lake margin at normal lake level.

  2. On each side of the transit posts sited on the lake margin at normal lake level, there shall be fastened in line with the side of the access lane, a notice board measuring not less than 800 mm by 600 mm painted bright orange with black lettering in the following form:

Access lane through which motor launches and waterskiers may pass at speeds greater than 5 miles per hour.

BATHERS KEEP OUT

  1. Three marker buoys of resilient plastic either barrel, drum, or spherical shaped, painted bright orange with vertical black stripes, shall be moored 50 metres apart and in line with the notice board erected on the lakeshore of the north-west boundary of the area described in the First Schedule to this notice, and in line with each set of transit posts, the first buoy being 50 metres from the water's edge.

  2. Marker buoys of a resilient plastic either barrel, drum, or spherical shaped, painted bright orange with vertical black stripes, shall be moored 200 metres from the lake margin at normal lake level and in line with the notice boards erected on the lakeshore of the north-west boundary of the area described in the First Schedule to this notice, and in line with each set of transit posts.

Notice of Order of Confiscation of Motor Vehicle

Notice is hereby given that on the 7th day of March 1978, in the Magistrate's Court at Lower Hutt, an order was made pursuant to section 44B (2) of the Criminal Justice Act 1954, for the confiscation of a 1972 Holden Belmont motorcar, registered number GA 553 belonging to Kevin Patrick Newby.

Setting Apart Maori Freehold Land as a Maori Reservation

Pursuant to section 439 of the Maori Affairs Act 1953, the Maori freehold land described in the Schedule hereto is hereby set apart as a Maori Reservation for the purpose of a burial ground for the common use or benefit of the Pare-wahawaha sub-tribe.

All that piece of land situated in Block XI, Rangitoto Survey District, and described as follows:
