  1. Rights and Obligations of Supply Authority—The Board shall exercise all rights and undertake all obligations previously exercised by the Council in carrying on its electricity undertaking.

  2. Representation—The Borough of Te Aroha shall remain a constituent district of the Board. The present representation whereby one elected member represents both the Borough of Te Aroha and the Borough of Thames as defined in the Order in Council, which reapportioned representation on the Board, dated 29 July 1959 and published in the New Zealand Gazette on 30 July 1959, shall continue until such time as representation on the Board is altered.

The present representative of the Boroughs of Te Aroha and Thames on the Board shall hold office until the next triennial local body election. All subsequent representatives of the two Boroughs shall be elected by the electors of the two Boroughs.

  1. Purchase Price—The price to be paid by the Board for the purchase of the said electricity undertaking, property, and assets, excepting only stock in hand and such other assets as are detailed in the Schedule to the Agreement shall be the sum of $254,068.30 plus the value of any capital expenditure out of revenue expended or otherwise put into the Council’s said electrical undertaking by the Council between the 1st day of April 1976 and the date of completion of this sale and purchase.

  2. Disposition of Assets—As from the date of completion of this sale and purchase the Board shall take over from the Council the electricity undertaking, property, and assets described in the Schedule to the Agreement.

  3. Tariffs—As from the date of completion the scale of charges payable by consumers (including the Council) of electrical power in the supply district of Te Aroha Borough shall be the charges payable by consumers in the Boards supply district.

  4. Staff—The Board shall continue to employ, as required by the Local Authorities (Employment Protection) Act 1963, all those persons employed in the Council’s electricity undertaking who elect to continue in that employment provided the conditions of employment shall be no less favourable than those enjoyed formerly.

  5. Date of Completion—The date of completion of the sale and purchase shall be 1 April 1977, and the merger shall come into force on that date. Possession of all property included in the sale shall be taken on that date.

ORDER

  1. Title—This order may be cited as the Local Elections and Polls (Postal Voting) Order 1977.

  2. Borough Councils authorised to conduct polls by postal vote—The Returning Officers, at the polls to be conducted pursuant to requests for polls made, in accordance with section 24 of the Local Government Act 1974, by the electors of the Borough Councils specified in the Schedule to this order to be held on the dates specified in the said Schedule, are hereby authorised to conduct those polls by postal vote.
