THE NEW ZEALAND GAZETTE

Now, therefore, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, acting pursuant to the Commissions
of Inquiry Act 1908, and by and with the advice and consent
of the Executive Council, hereby extend until the 2nd day of
May 1977 the time within which you, the said Ronald Keith
Davisson and James William Dempsey, are so required to
report, without prejudice to the continuation of the liberty
conferred upon you by the said Order in Council to report
your proceedings from time to time if you should judge it
expedient so to do, and hereby confirm the said Order in
Council and the Commission thereby constituted, save as
modified by these presents.

Given in Executive Council under the hand of His Excellency the Governor-General this 28th day of March 1977.

Consenting to Land Being Taken for Street Purposes in the City of Wellington

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the land described in the Schedule hereto being taken for street purposes.

WELLINGTON LAND DISTRICT

ALL that piece of land containing 23.37 perches, situated in the City of Wellington, being part Section 171 of the Town of Wellington, part of the said land being also Lot 2, D.P. 11727. All certificate of title, Volume 481, folio 15.

The Milton Borough (Validation of Notice of Poll) Order 1977

At the Government Buildings at Wellington this 28th day of March 1977.
Present:

THE RIGHT HON. B. E. TALBOYS PRESIDING IN COUNCIL

PURSUANT to section 90 of the Local Elections and Polls Act 1966, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the advice of the Minister of Local Government given at the request of the Returning Officer at a poll to be conducted by the Milton Borough Council, hereby makes the following order.

ORDER

  1. Title—This order may be cited as the Milton Borough (Validation of Notice of Poll) Order 1977.

  2. Notice of poll on Local Government Commission scheme validated—Whereas a final scheme of the Local Government Commission, publicly notified on the 6th day of December 1976, provided for the union of the Boroughs of Milton, Kaitangata, and Balclutha with the Counties of Clutha and Bruce to form the Molyneux District:

And whereas pursuant to section 24 of the Local Government Act 1974 a valid request for a poll (hereinafter referred to as the poll) was received from the electors of Milton Borough:

And whereas at a special meeting held on the 21st day of February 1977 the Milton Borough Council resolved that the poll will be held on Saturday the 2nd day of April 1977:

And whereas section 65 of the Local Elections and Polls Act 1966 provides that the Returning Officer shall give not less than 35 clear days' public notice before any poll:

And whereas the Returning Officer did not in this case give such public notice until the 12th day of March 1977 (which day is less than 35 clear days before the said 2nd day of April 1977):

And whereas section 90 of the Local Elections and Polls Act 1966 provides that the Governor-General may, inter alia, by Order in Council gazetted, validate acts done after the time required by the said Act:

And whereas it is considered that the electors of Milton Borough have received adequate notice of the holding of the poll notwithstanding the shortness of the notice:

And whereas it is desirable that the public notice of the poll be declared to have been validly given:

Be it therefore declared as follows:

Notwithstanding the public notice of the poll was given on the 12th day of March 1977, which date is less than 35 clear days before the poll, it is hereby declared that public notice of the poll was and always has been validly given for the purposes of section 65 of the Local Elections and Polls Act 1966.

Union of the Borough of Waipukurau and the County of Waipukurau

Present:

THE RIGHT HON. B. E. TALBOYS PRESIDING IN COUNCIL

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on 1 April 1977.

Constitution

  1. The districts of the Borough of Waipukurau and the County of Waipukurau shall be united under the name of the Waipukurau District (in this order referred to as “the district”).

  2. The council of the district shall be a district council under the name of “the Waipukurau District Council” (in this order referred to as “the district council”).

  3. The Waipukurau Borough Council and the Waipukurau County Council (in this order referred to collectively as “the uniting authorities”) shall be dissolved.

Representation

  1. The district shall be divided into 4 ridings having representation on the district council as follows:

Waipukurau Riding—comprising the area of the former Waipukurau Borough, 5 councillors:

Hatuma Riding—comprising the area of the Waipukurau Riding of the former County of Waipukurau, 2 councillors:

Patangata Riding—comprising the area of the Patangata Riding of the former County of Waipukurau, 3 councillors.

Porangahau Riding—comprising the area of the Porangahau Riding of the former County of Waipukurau, 2 councillors:

  1. Until the councillors of the district council, to be elected at the next triennial general election of councillors, come into office, the district council shall comprise 18 members, being the Mayor and councillors of the uniting authorities prior to union.

  2. The first meeting of the district council shall be called by the person holding office as Clerk of the Waipukurau County Council immediately prior to union; and at that meeting there shall be elected one member of the district council to be Chairman.

  3. The district council may appoint a councillor or councillors to officiate at functions within the Waipukurau Riding which were formerly attended by the Mayor of Waipukurau.

  4. The community and community council of Otane shall enure as if constituted by the district council.
