Declaring a Stormwater Drainage Easement Over Land Taken for a Technical Institute in Block VII, Heretaunga Survey District, City of Napier and Hawke's Bay County

Pursuant to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the stormwater drainage easement, described in the Second Schedule hereto, is hereby taken for a technical institute over the land, described in the First Schedule hereto, to be held appurtenant to the land held for a technical institute, described in the Third Schedule hereto, from and after the 12th day of August 1976.

SECOND SCHEDULE

DESCRIPTION OF EASEMENT

THE full, free and uninterrupted right, liberty, and licence for Her Majesty the Queen and her successors (hereinafter referred to as “the Crown”) from time to time and at all times, to drain, discharge, or convey stormwater along, over, or under the land, described in the First Schedule hereto, and for that purpose to lay and maintain a line of pipes through and under the land, described in the said First Schedule, and secondly, in order to construct and maintain the said line of pipes, the full free uninterrupted and unrestricted right, liberty, and licence for the Crown or any servant, agent, or workman of the Crown, to enter upon the land, described in the said First Schedule, for the purpose of laying, inspecting, cleansing, repairing, maintaining, or renewing any such line of pipes or any part or parts thereof, and of opening up the soil of that land as may be necessary and reasonable.
