Union of Rodney County and Warkworth Independent Town District

ORDER IN COUNCIL

At the Government House at Wellington this 20th day of December 1976

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on 1 January 1977.

CONSTITUTION

  1. The district of the Independent Town District of Warkworth (herein referred to as “the town district”) shall be united with the County of Rodney (herein referred to as “the county”).

  2. The Warkworth Town Council (herein referred to as “the town council”) shall be dissolved.

  3. The area of the town district shall be a community having the name “The Warkworth Community” (herein referred to as “the community”) and shall be within the jurisdiction of a district community council.

REPRESENTATION

  1. There shall be one councillor to represent the Warkworth community on the Rodney County Council (herein referred to as “the county council”).

  2. For not more than 10 years, as the county council may decide, the council shall consist of not more than 19 councillors.

  3. Until the next triennial general election of councillors, the Warkworth community shall be represented on the county council by the person who was Chairman of the town district immediately before union;

Provided that if the Chairman of the town council is unable or unwilling to serve as the representative of the Warkworth Riding, section 160 of the Local Government Act (which relates to the election of members of a territorial authority to represent a ward or riding that comprises a community under the jurisdiction of a district community council) shall apply.

  1. Until the next triennial general election of councillors, the Warkworth District Community Council shall comprise the members of the town council holding office immediately before union, and the person who was Chairman of the town council immediately before union shall be the Chairman of the district community council.

RATING

  1. The system of rating in the county shall be the land value system.

  2. For the purposes of rating the community shall form part of the northern division of the county.

FINANCE

  1. The special funds of the town district shall be used only for the purposes for which they were set aside and for the benefit only of the community.

  2. For accounting and other financial purposes the union shall be deemed to have taken place at the commencement of the financial year in which the provisions of this order come into force.

PETROLEUM TAX

  1. For the purposes of the Local Authorities (Petroleum Tax) Act 1970, the county shall be the successor of the town district.

TOWN AND COUNTRY PLANNING

  1. The operative district planning scheme of the town district shall be the operative District Planning Scheme for the community.

  2. Pursuant to section 28B of the Town and Country Planning Act 1953, the county council need not prepare a new district scheme for the county until the existing Rodney County District Planning Scheme is next due for review.

TRANSITIONAL

16 (a) All property, real or personal, belonging to the corporation of the town district shall vest in the corporation of the county;

(b) All functions, powers, rights, and duties heretofore vested in or imposed upon the town council, shall become vested in and imposed upon the county council;

(c) All rates or other money payable to the town council shall become due and payable to the county council;

(d) All actions, suits, and proceedings pending by or against the corporation of the town district may be carried on and prosecuted by or against the corporation of the county;

(e) The duties, powers, and functions of the Chairman and Town Clerk of the town council (if any) shall be exercised by the Chairman and County Clerk of the county respectively;

(f) All liabilities, contracts, and engagements of the town council shall become liabilities, contracts and engagements of the county council;

(g) All bylaws in force in the town district at the time of the union which are applicable to the altered circumstances shall become bylaws of the county, and may be revoked or altered by the county council, but until so revoked or altered every such bylaw shall remain in force in the area only in which it was in force prior to that union; and every bylaw which cannot be restricted to that area shall be deemed inapplicable, and all bylaws which are inapplicable to the altered circumstances shall be deemed to have been revoked by the union.

  1. All valuation rolls, electors’ rolls, electors’ lists, rate records, farm land rolls, and rate postponement lists in force within the town district shall continue in force until new such rolls, lists, and records are made for the community.

PURSUANT to the Forest and Rural Fires Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Pouto Rural Fire District Order 1976.

(2) This order shall come into force on the day after its notification in the New Zealand Gazette.

  1. In this order, unless the context otherwise requires the “Act” means the Forest and Rural Fires Act 1955, “District” means the Pouto Rural Fire District.

PART I—CONSTITUTION OF THE POUTO RURAL FIRE DISTRICT

  1. The area, specified in the Schedule to this order, is hereby constituted and declared to be a rural fire district to be known as the Pouto Rural Fire District.

  2. The trees and other plants on the land, described in the Schedule to this order, are hereby specified as the property for the protection for which the district is constituted.

  3. The period between the first day of October in any one year and the thirtieth day of September in the following year (both days inclusive) is hereby declared to be a closed fire season in the district.

  4. The Pouto Rural Fire District shall be administered for the purposes of the said Act, by the Minister of Forests.
