And with the like advice and consent I do further appoint
you, the said Eric Francis Rothwell, to be Chairman of
the Commission:
And for better enabling you to carry these presents into
effect you are hereby authorised and empowered to make
and conduct any inquiry hereunder, in accordance with the
Commissions of Inquiry Act 1908, at such times and places
as you think expedient, with power to adjourn from time
to time and place to place as you think fit, and so that
these presents shall continue in force and the inquiry may
at any time and place be resumed although not regularly
adjourned from time to time or place to place:
And you are hereby strictly charged and directed that
you shall not at any time publish or otherwise disclose,
save to me in pursuance hereof or by my direction, the
contents or purport of any report so made or to be made
by you or any evidence or information obtained by you
in exercise of the powers hereby conferred on you except
such evidence or information as is received in the course
of a sitting open to the public:
And it is hereby declared that the powers hereby con-
ferred shall be exercisable notwithstanding the absence at
any time of any one member of the Commission so long
as the Chairman and one other member are present and
concur in the exercise of those powers:
And it is hereby further declared that you have liberty
to report your proceedings and recommendations hereunder
from time to time if you judge it expedient to do so:
And, using all due diligence, you are required to report
to me in writing under your hands not later than the 31st day
of July 1975 your findings and opinions on the matters afore-
said, together with such recommendations as you think fit
to make in respect thereof.

Boundaries of County of Masterton and Borough of Masterton
Altered

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Act 1974 and the Local
Government Commission Act 1967 (to the extent that it
continues in force in relation to this order), His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby makes the following
order.
O R D E R
- This order shall come into effect on 1 April 1975.
- The boundaries of the districts of Masterton County
and Masterton Borough are hereby altered by excluding from
the district of Masterton County the areas described in the
First Schedule hereto and including them in the district of
Masterton Borough; and by excluding from the district of
Masterton Borough the areas described in the Second
Schedule hereto and including them in the Opaki Riding
of Masterton County. - For a period of not more than 10 years from the date
of the alteration of boundaries herein prescribed the Master-
ton Borough Council may apply the provisions of sections 111A
to 1110 of the Counties Act 1956 as if for the purposes thereof
the borough were a county. - Except as otherwise provided herein or in the Local
Government Commission Act 1967 (to the extent that it con-
tinues in force in relation to this order), the provisions of
the Municipal Corporations Act 1954 and the Counties Act
1956 shall apply as appropriate to the alterations of bound-
aries herein provided. - So far as they are applicable and with the necessary
modifications the provisions of section 99A of the Land
Transfer Act 1952 shall apply to the alteration of boundaries
hereby provided.
FIRST SCHEDULE
(Areas proposed to be excluded from Masterton County and
included in Masterton Borough)
WELLINGTON LAND DISTRICT—MASTERON COUNTY
FIRSTLY, all that area containing 60 hectares, more or less,
bounded by a line commencing at the southernmost corner
of Lot 18, D.P. 16228, and proceeding easterly along the
northern side of No. 52 State Highway (Te Ore Ore Road)
and its production to the right bank of the Ruamahanga
River; thence south-westerly along that bank to the left bank
of the Waipoua River; thence generally northerly and easterly
along the boundaries of the Borough of Masterton as described
in Gazette, 1968, page 715, to the point of commencement.
Secondly, Lots 1 and 2, D.P. 27833, containing together
0.7840 hectares, more or less, situated in Johnstone Street.
Thirdly, all that area containing 132 hectares, more or less,
bounded by a line commencing at the southernmost corner
of Lot 31, D.P. 16320, and proceeding south-westerly along
the north-western boundary of Section 30, Manaia District,
and its production to the south-western side of Manaia Road;
thence north-westerly along that side to a point in line with
the south-eastern boundary Lot 10, D.P. 16449; thence
generally north-easterly and south-easterly along the bound-
aries of the Borough of Masterton as described in Gazette,
1968, page 715, to the point of commencement.
Fourthly, all that area containing 178 hectares, more or
less, bounded by a line commencing at the intersection of
the south-western side of Manaia Road and the south-eastern
side of South Road and proceeding south-westerly along the
latter side to the left bank of the Waingawa River; thence
north-westerly along that bank to a point in line with the
south-eastern side of the Wellington-Napier Railway; thence
north-easterly to and along that side to and along the
western side of Upper Manaia Road to a point in line with
the south-eastern side of the railway, aforesaid, and to and
along that side to the northernmost corner of Lot 2, D.P.
26961; thence generally south-easterly along the boundaries
of the Borough of Masterton as described in Gazette, 1968,
page 715, to the point of commencement.
Fifthly, Lots 2 and 3, D.P. 365, containing together
0.8168 hectares, more or less, situated in Chamberlain Street.
SECOND SCHEDULE
(Areas proposed to be excluded from Masterton Borough
and included in Masterton County)
WELLINGTON LAND DISTRICT—MASTERTON BOROUGH
FIRSTLY, all that area containing 1.3590 hectares, more or
less, bounded by a line commencing at the northernmost
corner of Lot 2, D.P. 26961, and proceeding north-easterly
along the south-eastern side of the Wellington-Napier Rail-
way to the northernmost corner of Lot 1, D.P. 31636; thence
north-westerly along the production of the south-western side
of Judds Road to the north-western side of Railway Road;
thence south-westerly and southerly along the boundaries of
the Borough of Masterton as described in Gazette, 1968,
page 715, to the point of commencement.
Secondly, all that area containing 4.3500 hectares, more or
less, bounded by a line commencing at a point on the north-
western side of Kibblewhite Street in line with the south-
western boundary of Lot 3, D.P. 16822, and proceeding
south-easterly to and along that boundary to the northern-
most corner of Lot 8, D.P. 21170; thence easterly along a
right line to the north-western corner of Lot 9, D.P. 21170;
thence generally northerly and south-westerly along the bound-
aries of the Borough of Masterton as described in Gazette,
1968, page 715, to the point of commencement.
