Declaring Land Taken Subject to Certain Rights for State
Housing Purposes in the City of Napier

Pursuant to section 32 of the Public Works Act 1928, the
Minister of Works and Development hereby declares that,
a sufficient agreement to that effect having been entered into,
the land described in the First Schedule hereto is hereby
taken subject to the sewage easement created by transfer
310797.7, and subject to the fencing covenant contained in
transfer 310797.8; and the land described in the Second
Schedule hereto is hereby taken, subject to the sewage ease-
ment created by transfer 310797.10, and subject to the fencing
covenant contained in transfer 310797.11; and the land
described in the Third Schedule hereto, is hereby taken,
subject to the fencing covenant contained in transfer 310797.2;
and the land described in the Fourth Schedule hereto, is
hereby taken, subject to the fencing covenant contained in
transfer 310797.8; and the land described in the Fifth
Schedule hereto is hereby taken, subject to the fencing cove-
nant contained in transfer 310797.11, Hawke’s Bay Land
Registry, for State housing purposes from and after the 8th day
of May 1975.

All that piece of land containing 664 square metres situated
in the City of Napier, being Lot 50, D.P. 13898. All certificate
of title No. F4/404, Hawke’s Bay Land Registry.

Declaring an Easement Over Land Taken for Drainage in
Block XI, Tauranga Survey District, in Tauranga County
and the Borough of Mount Maunganui

Pursuant to section 32 of the Public Works Act 1928, the
Minister of Works and Development hereby declares that,
a sufficient agreement to that effect having been entered
into, the easement in gross described in the First Schedule
hereto is hereby taken over the land described in the Second
Schedule hereto for drainage and shall vest in the Mayor,
Councillors, and Citizens of the Borough of Mount Maunganui
from and after the 8th day of May 1975.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

1. The full, free, uninterrupted, and unrestricted right, liberty,
   and privilege for the Mount Maunganui Borough Council
   from time to time and at all times to drain and convey
   storm- and surface-water only under the said land described
   in the Second Schedule hereto.

2. The full, free, uninterrupted, and unrestricted right, liberty,
   and privilege for the Mount Maunganui Borough Council for
   the purposes of the easement:

(a) To lay, place, and maintain or to have laid, placed,
and maintained a line of pipes of sufficient internal
diameter and of suitable material for the purpose
under the surface of the land described in the Second
Schedule hereto

(b) In order to construct and maintain the efficiency of the
said pipe line, the full, free, uninterrupted, and
unrestricted right, liberty, and privilege for the Mount
Maunganui Borough Council, its agents, and work-
men with any tools, implements, machinery, vehicles,
or equipment of whatsoever nature necessary for
the purpose to enter upon the land over which
the easement is granted and to remain there for
any reasonable time for the purpose of laying, inspect-
ing, cleansing, repairing, maintaining, and renewing
the pipe line or any part thereof and of opening
up the soil of that land to such extent as may be
necessary and reasonable in that regard subject to
the condition that as little disturbance as possible
is caused to the surface of the land of the Tauranga
City Council and that the surface is restored as nearly
as possible to its original condition and any other
damage done by reason of the aforesaid operations
is repaired.
