No. 850
Decision of the Indecent Publications Tribunal
In the matter of the Indecent Publications Act 1963, and in
the matter of an application by Waverley Publishing Company
for a decision in respect of the following publication: The
Debauched Hospodar and Memoirs of a Young Rakehell by
Guillaume Apollinaire and published by Holloway House
Publishing Co. of Los Angeles:
Date of Hearing: 30 July 1975, at Wellington.
No appearance of the applicant but written submissions
were received.
Mr P. E. Leloir and Mr K. G. Murray appeared on behalf
of the Comptroller of Customs.
DECISION OF THE TRIBUNAL
This is an English translation of two works by Guillaume
Apollinaire originally published in French in 1907 as Les
onze mille verges and Les exploits d'un jeune Don Juan.
This edition which was first published in 1967, and has
quite a substantial introduction on Apollinaire's life and
work, and presumably the same translation as that dealt
with in decision No. 15 of 24 February 1965. That decision
classified the book as “indecent unless circulation is restricted
to persons professionally engaged in the study of abnormal
psychology”.
Considering this again, after more than ten years, the
Tribunal is now inclined to the view that this was an unduly
restrictive classification which probably took insufficient
account of the importance of Apollinaire as a French writer
of the early 20th century. He is best known as a poet with
a very wide and deep influence on the surrealist movement,
in both art and literature, a movement of which he was,
if not exactly the founder, a major progenitor, and his influence
has extended steadily since his death in 1918. Critics
have taken the view that the two works (which are very
different) were both parodies, in the one case of the works
of the Marquis de Sade, and the other of a symbolist novel
dealing with a boy’s first sexual experiences. High-spirited
and exaggerated for effect, they are unlikely to have a depraving
effect. They should certainly be available to students
of literature, of art, and and of the pre-World War I Parisian
artistic society of which Apollinaire was a prominent member—this list could indeed be extended, and we consider these
ends are best served by imposing a general age classification.
We accordingly find the book indecent in the hands of
persons under the age of eighteen years.
MAURICE M. GREIG, Chairman.
7 November 1975.
