  1. The council of the Borough of Eketahuna is hereby dissolved.

  2. For the purpose of representation only, the said county is hereby divided into four ridings with the following names:
    Alfredton Riding: being the former Alfredton Riding of the Eketahuna County.
    East Riding: being the former East Riding of the Eketahuna County.
    West Riding: being the former West Riding of the Eketahuna County.
    Eketahuna Riding: being the area of the former Borough of Eketahuna.

  3. The council of the said county shall consist of 10 members with representation as follows:
    Alfredton Riding: 3 councillors.
    East Riding: 2 councillors.
    West Riding: 4 councillors.
    Eketahuna Riding: 1 councillor.

  4. Until the members of the council of the said county, to be elected at the first triennial general election of councillors after union, shall come into office, the council shall comprise:
    (a) The members of the Eketahuna County Council holding office on the day immediately preceding the union herein prescribed; and
    (b) The Mayor of Eketahuna Borough holding office on the day immediately preceding the union herein prescribed.

  5. The Eketahuna Riding of the said county shall be a community having the name of Eketahuna Community and subject to paragraph 9 of this order, the provisions of Part VII of the Local Government Act 1974 (so far as they relate to communities under the jurisdiction of community councils) shall apply in all respects as if the said community had been constituted under section 146 of that Act.

  6. Until the first general election of councillors after the union, every person who on the day immediately preceding the union was a member of the Eketahuna Borough Council shall be deemed to be a member of the Eketahuna Community Council, whether or not he is an elector of the said county having a residential qualification in respect of an address in the community, and, unless that person sooner vacates office, he shall continue to be a member of the community council, and, if he was the Mayor of the Borough Council, to continue to be the Chairman of the Community Council.

  7. In addition to any other powers and functions conferred or imposed upon or delegated to the Eketahuna Community Council by or pursuant to the Local Government Act 1974 or any other enactment, section 151 (4) and sections 152 to 157 of the Local Government Act 1974 shall apply in respect of the Eketahuna Community and the community council thereof as if every reference in those sections-
    (a) To a community that is within the jurisdiction of a district community council were a reference to the community within the jurisdiction of the Eketahuna Community Council:
    (b) To a district community council were a reference to the Eketahuna Community Council
    (c) To a riding comprising a community included a reference to the Eketahuna Riding of the said county.

  8. The system of rating shall be the unimproved or land value, as the case may be.

  9. All the valuation rolls, electors' lists, electors' rolls, rate records, farm land rolls, and rate postponement lists in force on the formation of the said county shall continue in force and be deemed to be the valuation rolls, electors' lists, electors' rolls, rate records, farm land rolls, and rate postponement lists of the said county until new valuation rolls, electors' lists, electors' rolls, rate records, farm land rolls, and rate postponement lists are made for the said county.

  10. For the purposes of the Local Authorities (Petroleum Tax) Act 1970 the following provisions shall apply:
    (a) The district of the said county shall be deemed always to have been a constituent district of the Wairarapa Petroleum Tax Area.
    (b) The rate revenue of the said county for the financial year that ended with the 31st day of March 1974 shall be the sum of the rate revenues for that period of the former Eketahuna Borough and Eketahuna County.

  11. The transfer of any members of the staff of the Eketahuna Borough Council and the Eketahuna County Council to the service of the council of the said county shall be deemed to be transfers of permanent employees within the meaning of section 4 of the Local Authorities (Employment Protection) Act 1963 and the provisions of that Act shall, with the necessary modifications, apply accordingly.

  12. So far as they are applicable, and with the necessary modifications, the provisions of section 99A of the Land Transfer Act 1952 shall apply to the union herein prescribed.

  13. (1) All property, real or personal, belonging to the Corporation of the Borough of Eketahuna shall become vested in the Corporation of the said county.
    (2) All functions, powers, rights, and duties theretofore vested in or imposed upon the Eketahuna Borough Council shall become vested in and imposed upon the council of the said county.
    (3) All rates or other money payable to the Eketahuna Borough Council shall become due and payable to the council of the said county.
    (4) All actions, suits, and proceedings pending by or against the Corporation of the Borough of Eketahuna may be carried on and prosecuted by or against the Corporation of the said county.
    (5) All duties, powers, and functions of the Mayor and Town Clerk of the Eketahuna Borough Council shall be exercised by The Chairman and County Clerk respectively of the said county.
    (6) All the liabilities, contracts, and engagements of the Eketahuna Borough Council shall become liabilities, contracts, and engagements of the council of the said county.
    (7) All bylaws in force in the Borough of Eketahuna at the time of the merger which are applicable to the altered circumstances shall become bylaws of the said county, and may be revoked or altered by the council of the said county, but until so revoked or altered every such bylaw shall remain in force in the area only in which it was in force prior to the union; and every bylaw which cannot be restricted to that area shall be deemed inapplicable, and all bylaws which are inapplicable to the altered circumstances shall be deemed to have been revoked by the union.

  14. On the formation of the said county the Fire Authority of the Eketahuna Urban Fire District shall be the council of the said county and the members of the Eketahuna Fire Committee holding office on the day immediately preceding the union herein prescribed shall become the Fire Committee of the council of the said county as if that committee had been so established pursuant to section 25 of the Fire Services Act 1972.

  15. The Order in Council made on the 25th day of November 1974 providing for the Union of Eketahuna Borough and Eketahuna County* is hereby revoked.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to the Hydatids Act 1968, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Ashburton Borough Hydatids Control District Order 1974.
    (2) This order shall come into force on the day after the date of its notification in the Gazette.

  2. The area comprising the Borough of Ashburton as from time to time constituted is hereby declared to be an hydatids control district to be called the Ashburton Borough Hydatids Control District.

  3. The Ashburton Borough Council is hereby appointed the hydatids control authority for the Ashburton Borough Hydatids Control District.
