Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Howard Estate Act 1914, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order may be cited as the Smedley Boys' Training Farm Approval Order 1946, Amendment No. 4, and shall be read together with and deemed part of the Smedley Boys' Training Farm Approval Order 1946* (hereinafter referred to as the "principal order").

Clause 8 of the Schedule to the principal order is hereby amended by revoking paragraph (b) as inserted by clause 3 of the Smedley Boys' Training Farm Approval Order 1946, Amendment No. 1†, and substituting the following paragraph:
"(b) Be paid for his services in performing farming work during the course of his training and instruction an allowance by way of remuneration and a clothing and such other allowances and at such rates as the Minister on the recommendation of the board may from time to time approve."

Exempting Certain Maori Land From Rates

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 149 of the Rating Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby exempts the Maori freehold land described in the Schedule hereto from the liability for the payment of rates.

NORTH AUCKLAND LAND DISTRICT
ALL that piece of land situated in Block VIII, Kaeo Survey District, and described as follows:

Hawke's Bay County Foreshore Order 1974

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

(1) This order may be cited as the Hawke's Bay County Foreshore Order 1974.
(2) This order shall come into force on 24 November 1974. -
In this order—
"The Act" means the Harbours Act 1950:
"The Council" means the Hawke's Bay County Council:
"Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:
"Minister" means the Minister of Transport and includes any officer, person, or authority acting by or under the direction or authority of the Minister. -
There is hereby granted to the Council for a period of 21 years from the commencement of this order, the control of foreshore described in the First Schedule to this Order, subject to the provisions of section 165 of the Act, and to the conditions specified in the Second Schedule to this Order.
FIRST SCHEDULE
DESCRIPTION OF FORESHORE
THAT portion of the foreshore in Hawke's Bay County commencing at a point at the junction of the eastern boundary of Block V, Kidnappers Survey District, with the coastline, and extending in a southerly direction to Te Wainohu Point, midway on the eastern boundary of Section 3, Block II, Waimarama Survey District. As the same is shown, coloured red, on plan marked M.D. 7108, and deposited in the office of the Ministry of Transport at Wellington.
SECOND SCHEDULE
CONDITIONS

Her Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress out and over the said foreshore without payment.

Nothing herein contained shall authorise the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder and that are or may hereafter be in force.

The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present or may be at any time laid down within the said area of foreshore.

The Council may enclose any part of parts of the foreshore described in the First Schedule hereto for the purpose of holding athletic sports or games and may by bylaw fix a charge for admission to such enclosed part or parts
Provided that the total number of days on which such enclosures are made shall not exceed 6 in any 1 year. -
Nothing herein contained shall authorise the Council to move or cause to be removed any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council six calendar months' previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last known address of the Council in New Zealand.

Amending an Order in Council Appointing Five Non-elective Members of the Hauraki Catchment Board

THE RIGHT HON. W. E. ROWLING PRESIDING IN COUNCIL
PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 3rd day of August 1949 and published in Gazette, 4 August 1949, Vol. II, page 1524, appointing five non-elective members of the Hauraki Catchment Board, by deleting "District Engineer, Ministry of Works, Hamilton" and substituting "District Civil Engineer, Ministry of Works and Development, Hamilton".
