The Rotorua City Waters Control Order 1973

ORDER IN COUNCIL
At the Government Buildings at Wellington this 2nd day of April 1973
Present:
THE HON. M. RATA PRESIDING IN COUNCIL
Pursuant to section 8A of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

  1. Title and commencement—(1) This order may be cited as the Rotorua City Waters Control Order 1973.
    (2) This order shall come into force on the date of its notification in the Gazette.
  2. Interpretation—In this order—
    “The Council” means the Rotorua City Council;
    “Minister” means the Minister of Transport and includes any officer, person, or authority acting by or under the direction or authority of the Minister.
  3. Control of City Waters—There is hereby granted to the Council, for a period of 2 years from the commencement of this order, the control of city waters described in the First Schedule to this order, subject to the provisions of section 8A of the Act and to the conditions specified in the Second Schedule to this order.
  4. Amendment—The Order in Council of 11 August 1965* granting control of waters to the Rotorua County Council is hereby amended by inserting the words “excepting thereout the waters covering the lake bed controlled by the Rotorua City Council by Order in Council of 1 July 1968†” after the words “Paetaetaramoa Stream”.
    FIRST SCHEDULE
    ALL the waters of Lake Rotorua extending 66 ft from the margin of the lake at its ordinary level and commencing at the easternmost corner of Kawaha 3G in Block XIII, Rotoiti Survey District, and proceeding south-easterly generally along the margin of the lake to the west bank of the Puarenga Stream.
    SECOND SCHEDULE
  5. Subject to the provisions of section 8A of the Act, the Council for and within the area of the waters described in the First Schedule hereto—
    (a) May, by bylaw, do anything which a harbour board may do by bylaw under section 232 of the Act;
    (b) May appoint officers and define or limit their powers or duties;
    (c) Shall have all the powers, functions, duties, and authorities of a harbour board under the Act as if it were constituted a harbour board;
    (d) May expend money out of its general fund or account for the purpose of exercising and performing the control, powers, functions, duties, and authorities conferred by this Order in Council.
  6. Bylaws made by the Council under the authority of this Order in Council shall not come into force until they have been approved by the Minister, by notice in the Gazette.
  7. The rights, powers, privileges, control, functions, duties, and authorities conferred by or under this Order in Council shall continue to be in force for 2 years from the day following the date of its notification in the Gazette, unless
    in the meantime such rights, powers, privileges, control, functions, duties, and authorities shall be altered, modified, or revoked by competent authority.
  8. The said rights, powers, privileges, control, functions, duties, and authorities may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Council in New Zealand.

    Appointments, Promotions, Extensions, Transfers, Resignations, and Retirements of Officers of the Royal New Zealand Navy
    Pursuant to section 35 of the Defence Act 1971, His Excellency the Governor-General has approved the following appointments, promotions, extensions, transfers, resignations, and retirements of officers of the Royal New Zealand Navy:
    The appointment of Commander P. K. Laker, C.ENG., M.I.E.R.E., is extended to 21 December 1973.
    Lieutenant Commander (temp. Commander) P. N. Wright, D.S.C., to be Commander, with seniority from 31 March 1972 and effect from 16 March 1973.
    Lieutenant Commander John Adrian Vennell, LL.B., is placed on the Retired List with effect from 2 March 1973.
    Lieutenant Commander N. McK. Walker to be Commander, with seniority from 16 March 1972 and effect from 16 March 1973.
    Lieutenant Commander E. D. Deane, LL.B., to be Acting Commander with effect from 2 April 1973.
    Lieutenant C. E. Middlemiss to be Lieutenant Commander with seniority and effect from 8 March 1973.
    Lieutenant (temp. Lieutenant Commander) J. L. Shipp, C.ENG., A.M.I.MAR.E., to be Lieutenant Commander with seniority and effect from 24 March 1973.
    Lieutenant (temp. Lieutenant Commander) D. W. Morgan, to be Lieutenant Commander with seniority and effect from 1 April 1973.
    The seniority of Lieutenant E. A. Craig is antedated to 17 February 1968.
    Lieutenant Phillip Arthur Churchill is placed on the Emergency List of the RNZN, with effect from 4 February 1973.
    The appointment of Lieutenant C. F. George is extended to 30 May 1978.
    Sub Lieutenant A. J. Chandler to be Lieutenant, with seniority from 23 July 1971 and effect from 1 November 1972.
    Sub Lieutenant D. V. Coronno to be Lieutenant, with seniority from 3 May 1972 and effect from 1 November 1972.
    Ensign (Acting Sub Lieutenant) O. J. Young to be Sub Lieutenant, with seniority from 6 January 1973 and effect from 14 February 1973.
    Dennis David Davies (RN Rtd.) is appointed to the RNZN for a period of 5 years, in the rank of Lieutenant (Special Duties List), with seniority from 9 March 1968 and effect from 9 March 1973.
    Stephen John Peters, B.COM., is appointed to a short-service commission in the RNZN for a period of 8 years, in the rank of Sub Lieutenant (on prob.), with seniority from 13 January 1972 and effect from 28 March 1973.
    Ross George Garnett Sanson, Y102234, CRD, to be Lieutenant (on prob.) (Special Duties List), with seniority from 1 January 1973, on appointment to the RNZN for a period of 12 years, with effect from 15 February 1973.
    Geoffrey Clough, T16577, WRE MECH., to be Lieutenant (on prob.) (Special Duties List), with seniority from 1 January 1973, on appointment to the RNZN for a period of 12 years, with effect from 15 February 1973.
    WOMEN'S ROYAL NEW ZEALAND NAVAL SERVICE
    The appointment of 3rd Officer P. M. McGhie is reduced to 18 April 1973.
    Janice Leslie is appointed to the WRNZNS as Fourth Officer (on prob.) with effect from 13 February 1973.
    Pamela Ruth Wayne, B.SC.(HONS.), is appointed to the WRNZNS as Fourth Officer (on prob.) with effect from 13 February 1973.
