ORDER IN COUNCIL

At the Government Buildings at Wellington this 15th day
of January 1973

Present:

THE HON. N. E. KIRK PRESIDING IN COUNCIL

PURSUANT to the Local Government Commission Act 1967,
His Excellency the Governor-General, acting by and with
the advice and consent of the Executive Council, hereby
makes the following order.


O R D E R

  1. This order shall come into effect on 1 April 1973.

  2. The boundaries of the districts of the County of Hutt and
    the City of Lower Hutt shall be altered by excluding from
    the district of the said county and including in the district
    of the said city:

(a) The area described in the First Schedule hereto;
(b) The area described in the Second Schedule hereto; and
(c) The area described in the Third Schedule hereto.

  1. The areas described in the Fourth Schedule hereto shall
    be included in the district of the said city.

  2. For the purpose of representation only, the district of
    the City of Lower Hutt herein prescribed shall, for a period
    expiring on completion of the 3-year term of office of the
    councillors to be elected to the Lower Hutt City Council at
    the triennial election of councillors to be held in 1974, be
    divided into two wards as follows:

(a) The Epuni Ward, comprising the area described in the
Second Schedule hereto; and
(b) The Lower Hutt City Ward, comprising the areas
described in the Fifth Schedule hereto.

  1. Notwithstanding the provisions of paragraph (e) of
    section 4 of the Municipal Corporations Act 1954, nothing
    contained herein shall operate to prevent the Lower Hutt
    City Council, pursuant to section 23 of the Municipal Corpo-
    rations Act 1954, from subdividing the area described herein
    as the Lower Hutt City Ward into further wards, not exceeding
    five in number, for the period specified in clause 4 of this
    order.

  2. Nothing herein provided shall operate to prevent the
    Council of the City of Lower Hutt from continuing a ward
    system for representation purposes beyond the period herein-
    before prescribed in accordance with the provisions of
    section 23 of the Municipal Corporations Act 1954.

  3. For the period determined in clause 4 of this order, the
    Council of the City of Lower Hutt herein prescribed shall
    comprise 16 members, exclusive of the Mayor, and ward
    representation shall be as follows:

Epuni Ward ..... ..... ..... 1 member
Lower Hutt City Ward ..... ..... 15 members

  1. The first election of the Council referred to in clause 7
    of this order shall be held on the date fixed for the next
    triennial general election of members of local authorities
    pursuant to the provisions of the Local Elections and Polls
    Act 1966.

  2. Until the members of the Council of the City of Lower
    Hutt come into office following the triennial general election
    of councillors referred to in clause 8 of this order, the Council
    of the said City shall comprise the Mayor of the City of
    Lower Hutt holding that office immediately prior to the date
    on which this order takes effect, and 16 councillors as
    follows:

(a) Fifteen councillors to represent the Lower Hutt City
Ward who shall be the 15 councillors of the Lower
Hutt City Council holding office immediately prior
to the date on which this order takes effect; and
(b) One councillor to represent the Epuni Ward who shall
be the member of the Hutt County Council elected
to represent the Epuni Riding of Hutt County and
holding such office immediately prior to the date
on which this order takes effect.

  1. The rating system in the district of the City of Lower
    Hutt shall be the annual rental value system.
