  1. The transfer of any members of the staff of the Hutt County Council to the service of the Lower Hutt City Council in terms of the agreement between the Councils of the Cities of Wellington, Lower Hutt, Porirua, Upper Hutt, and the County of Hutt shall be deemed to be transfers of permanent employees within the meaning of section 4 of the Local Authorities (Employment Protection) Act 1963 and the provisions of that Act shall, with any necessary modifications, apply accordingly.

  2. So far as they are applicable and with the necessary modifications the provisions of section 99A of the Land Transfer Act 1952 shall apply to the alteration of boundaries herein provided.

  3. Except as otherwise provided herein or in the Local Government Commission Act 1967, the provisions of the Municipal Corporations Act 1954 shall apply to the alteration of boundaries herein provided.

  4. On the coming into effect of this order, the Hutt Valley and Bays United Urban Fire District shall be abolished and the Hutt Valley and Bays Fire Board shall be dissolved.

  5. The district of the City of Lower Hutt, following the alteration of boundaries herein provided, but excluding therefrom the areas described in the First and Fourth Schedules hereto, shall be constituted an Urban Fire District to be known as the Hutt Valley and Bays Urban Fire District.

  6. The Urban Fire Authority for the Hutt Valley and Bays Urban Fire District shall be a fire board to be known as the Hutt Valley and Bays Fire Board and shall comprise:
    (a) One member to be elected by the fire brigades in the said fire district in accordance with rules approved by the Minister of Local Government;
    (b) Three members to be elected to represent the Lower Hutt City Council; and
    (c) Three members to represent insurance companies carrying on business in the Hutt Valley and Bays Urban Fire District to be elected in accordance with section 29 of the Fire Services Act 1972.

  7. Until the members of the Hutt Valley and Bays Fire Board come into office following the next election of members of Fire Boards and Fire Committees held pursuant to subsection (1) of section 28 of the Fire Services Act 1972, the said Board shall comprise the members of the Hutt Valley and Bays Fire Board holding office immediately prior to the date on which this order takes effect.

  8. The Order in Council made on 24 March 1959 and published in the New Zealand Gazette on 25 March 1959, at page 386, constituting the Hutt Valley and Bays United Urban Fire District, is hereby revoked.

FIRST SCHEDULE

ALL that area in the Wellington Land District containing 1.7 square miles, more or less, being portion of the County of Hutt and reclamations bounded by a line commencing at a point on the mean high-water mark of Wellington Harbour in line with the north-eastern boundary of Section 17, Harbour District, in Block XIII, Belmont S.D., and proceeding generally northerly to and along that boundary and its production to and along the middle of Horokiwi Road to a point in line with the eastern boundaries of Section 156, Porirua District, and Section 40, Horokiwi Road District, and to and along the eastern boundaries of the said Section 156 and Sections 41 and 19, Horokiwi Road District, to the south-western corner of part Section 20, Horokiwi Road District (C.T. 444/197); thence easterly along the southern boundary of the said part Section 20 to its south-eastern corner; thence southerly along the boundaries of the Borough of Petone as described in Gazette, 1967, p. 2250, to the mean high-water mark of Wellington Harbour; thence south-westerly along the mean high-water mark of Wellington Harbour to the point of commencement.

SECOND SCHEDULE

ALL that area in the Wellington Land District containing 13 square miles, more or less, being portion of the County of Hutt bounded by a line commencing at the northernmost corner of Maungaraki 7 in Block VIII, Belmont S.D., and proceeding generally north-easterly along the south-eastern boundaries of Sections 22 and 24, Horokiwi Road District, the southern and eastern boundaries of Section 25, the generally eastern boundaries of Section 26, the south-eastern boundaries of Sections 27, 28, 29, 30, 31, 39, 33 and 34, Horokiwi Road District, the northern boundary of Section 343, Hutt District, and its production to the middle of a road, and along the middle of that road to a point in line with the northern boundary of Section 349, Hutt District; thence generally easterly to and along that boundary and its production to and along the middle of Belmont Road to a point in line with the northern boundary of Section 346, Hutt District, to and along the northern boundaries of Sections 346 and 433, Hutt District (including the crossing of Murphys Road), the eastern boundary of Section 433, Hutt District, and its production to and along the middle of a road passing through Section 436, Hutt District, to the north-western boundary of Section 258, Hutt District, along that boundary and the southern and eastern boundaries of Section 436, Hutt District (including the crossing of a road), the northern boundary of Section 437, Hutt District, the south-eastern and north-eastern boundaries of Section 18, Block IV, Belmont S.D., and the production of the last-mentioned boundary to and along the middle of a road and the middle of No. 58 State Highway to a point in line with the middle of the road adjoining the south-eastern boundaries of Section 10, Block IV, Belmont S.D.; thence generally southerly along the middle of No. 58 State Highway to a point in line with the north-eastern boundary of Section 452, Hutt District, to and along that boundary and the north-eastern boundary of Lot 2, D.P. 12488, the southern boundaries of Sections 270 and 269, Hutt District, and their production to the middle of the Hutt River, along the middle of that river to a point on the production of the north-eastern boundary of railway land as shown on S.O. Plan 23708 in Block IV, Belmont S.D., and along that production to the left bank of the Hutt River; thence generally south-westerly and westerly along the boundaries of the City of Lower Hutt and the Borough of Petone as described in Gazette, 1967, p. 2250, to the point of commencement.

THIRD SCHEDULE

ALL that area in the Wellington Land District containing 0.8 of a square mile, more or less, being portion of the County of Hutt bounded by a line commencing at the south-eastern corner of Section 248, Hutt District, in Block X, Belmont S.D., and proceeding easterly along the northern boundary of Section 235, Hutt District, to its north-eastern corner; thence generally southerly along the eastern boundaries of Sections 235 and 236, Hutt District, the northern and western boundaries of Lot 1, D.P. 2937, and the northern boundary of Section 277, Hutt District, to the south-eastern corner of Section 233, Hutt District; thence northerly and easterly along the boundaries of the City of Lower Hutt as described in Gazette, 1967, p. 2250, to the point of commencement.

FOURTH SCHEDULE

WARD Island, Somes Island, and Mokopuna Island containing together 0.11 of a square mile, more or less, situated in Wellington Harbour.

FIFTH SCHEDULE

FIRSTLY, the City of Lower Hutt as described in Gazette, 1967, p. 2250.

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on the 1st day of April 1973.

  2. The boundaries of the districts of the County of Hutt and the City of Wellington are hereby altered by excluding from the district of the said county and including in the district of the said city the area described in the First Schedule hereto.
