Declaring Road Taken for the Purposes of the North Auckland Main Trunk Railway at Te Hana

PURSUANT to sections 32 and 216 of the Public Works Act 1928, the Minister of Railways hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for the purposes of the North Auckland Main Trunk Railway on and after the 15th day of May 1972.

SCHEDULE
NORTH AUCKLAND LAND DISTRICT—RODNEY COUNTY
ALL that piece of land being:
A. R. P. Being
0 1 18 Road, adjoining railway land, and part Lot 2, D.P. 24208 (C.T. 687/197).
Situated in Block VIII, Otamatea Survey District.
As the same are more particularly delineated on the plan marked L.O. 26448 (S.O. 47335) deposited in the office of the Minister of Railways at Wellington, and thereon coloured green, edged green.

The Motor Launch (Lake Aratiatia and Waikato River) Notice 1972
———
PURSUANT to the Motor Launch Regulations 1962*, the Minister of Marine and Fisheries hereby gives the following notice:
- (a) This notice may be cited as the Motor Launch (Lake Aratiatia and Waikato River) Notice 1972.
(b) This notice shall remain in force for a period of 5 years from 6 May 1972 but the Minister reserves the right to revoke this notice if at any time the operations of exempted jet boats cause detrimental effects on the river or lake shores, or to the Wairakei Power Station.
- Subject to the conditions set forth in the Second Schedule hereto, regulation 11 (c) of the Motor Launch Regulations 1962 shall not apply during the hours of daylight to any jet boat holding a current survey certificate issued under Part IV of the Shipping and Seamen Act 1952 within the area described in the First Schedule hereto.

FIRST SCHEDULE
ALL that area of water on Lake Aratiatia and the Waikato River between a point† marked by a notice board on the western bank of the river approximately 100 yd downstream from the Huka Falls, and a point‡ marked by a notice board on the eastern side of the lake approximately 400 yd upstream from the Aratiatia Dam.

SECOND SCHEDULE

This notice shall not apply during the open season for shooting of water fowl in the Rotorua district.

This notice shall not apply to jet boats while passing the Wairakei Geothermal Power Station area which shall be marked as follows:
(a) In a prominent position on the western bank of the Waikato River approximately 250 yd downstream from the Wairakei Power Station there shall be placed a notice board 2 ft 6 in. by 2 ft painted highway yellow with black lettering in the following form:
WAIRAKEI POWER STATION
MAXIMUM SPEED ALL BOATS
5 M.P.H.
BETWEEN THIS POINT AND A POINT MARKED BY A NOTICE BOARD IMMEDIATELY UPSTREAM OF THE JUNCTION OF THE WAIRAKEI HOT STREAM.
(b) In a prominent position on the western bank of the Waikato River immediately upstream of the confluence of the Wairakei Stream and the Waikato River there shall be placed a notice board 2 ft 6 in. by 2 ft painted highway yellow with black lettering in the following form:
WAIRAKEI POWER STATION
MAXIMUM SPEED ALL BOATS
5 M.P.H.
BETWEEN THIS POINT AND A POINT MARKED BY A NOTICE BOARD 250 YARDS DOWNSTREAM FROM THE POWER STATION.
- (a) In a prominent position on the western bank of the Waikato River† approximately 100 yd downstream from the Huka Falls there shall be placed a notice board measuring not less than 2 ft 6 in. by 2 ft painted bright orange with black lettering in the following form:
NOTICE
“Motor Launch (Lake Aratiatia and Waikato River) Notice 1972 Regulation 11 (c) of the Motor Launch Regulations 1962 does not apply to approved jet boats operating during the hours of daylight between this point and a point marked by a notice board immediately upstream from the Aratiatia Dam.”
(b) In a prominent position on the eastern bank of Lake Aratiatia‡ upstream from the Aratiatia Dam there shall be placed a notice board measuring not less than 2 ft 6 in. by 2 ft painted bright orange with black lettering in the following form:
NOTICE
“The Motor Launch (Lake Aratiatia and Waikato River) Notice 1972 Regulation 11 (c) of the Motor Launch Regulations 1962 does not apply to approved jet boats operating during the hours of daylight between this point and a point marked by a notice board approximately 100 yd downstream from the Huka Falls.”

Cancellation of the Vesting in the New Plymouth City Council and Revocation of the Reservation Over Part of a Reserve
———
PURSUANT to the Reserves and Domains Act 1953, the Minister of Lands hereby cancels the vesting in the Mayor, Councillors, and Citizens of the City of New Plymouth and revokes the reservation over that part of the reserve for a site for pensioners’ flats described in the Schedule hereto.

TARANAKI LAND DISTRICT—NEW PLYMOUTH CITY
THAT portion of Lot 4, Deposited Plan 8154, containing 0.11 of a perch, more or less, being formerly part Lot 45, Deposited Plan 6845, more particularly shown on Deposited Plan 8154, and being part Section 48, Fitzroy District, and being part of the land contained in certificate of title, Volume 224, folio 40, Taranaki Land Registry.

Change of Purpose of a Reserve and Vesting in the Levels County Council
———
PURSUANT to the Reserves and Domains Act 1953, the Minister of Lands hereby changes the purpose of the reserve described in the Schedule hereto from a reserve for general education (plantation) purposes to a reserve for plantation purposes, and further, vests the said reserve in the Chairman, Councillors, and Inhabitants of the County of Levels, in trust, for plantation purposes.
