of before the commencement of this order, shall become the assets, liabilities, rights, and engagements of the Marlborough Harbour Board without the necessity of any instrument of transfer, assignment, or other assurance.
(2) Where any asset vested in the Marlborough Harbour Board, pursuant to subclause (1) of this clause, consists of an estate or interest in land, under the Land Transfer Act 1952, the provisions of section 99A of that Act (as inserted by section 11 of the Land Transfer Amendment Act 1966) shall apply accordingly.
5. All proceedings pending by or against the Kaikoura County Council in respect of its functions, under the Harbours Act 1950, immediately before the commencement of this order may be carried on or prosecuted by or against the Marlborough Harbour Board.

Exempting Land in the Southland Land District from the Operation of Part III of the Coal Mines Act 1925

PURSUANT to section 171 of the Coal Mines Act 1925, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, do hereby exempt the land described in the Schedule hereto from the operation of Part III of the Coal Mines Act 1925.

SOUTHLAND LAND DISTRICT
Lots 1 and 3, D.P. 1122, being part Section 5, Block XII, Town of Invercargill, situated in Block I, Invercargill Hundred: area, 13.8 perches, more or less. All certificate of title, Volume 89, folio 254, together with a right of way created by memorandum of transfer, No. 13731, over part Section 4, Block XII, Town of Invercargill, and subject to rights of way and other rights over the said Lot 3, D.P. 1122, created by memoranda of transfer, No. 13730, 30831, and 55378.

PURSUANT to the Coal Mines Act 1925, His Excellency the Governor-General hereby sets apart the land described in the Schedule hereto for the purposes of Part III of the Coal Mines Act 1925; save and excepting rights to prospect or mine for coal or other minerals that were existing at the date of this notice.
