Right of Way Easement over Land Taken for Fish Breeding Purposes in Block XVI, Rotorua Survey District, Rotorua County

A PROCLAMATION
PURSUANT to the Public Works Act 1928, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, hereby proclaim and declare that a right of way easement over the land described in the Schedule hereto is hereby taken for fish breeding purposes, vesting in Her Majesty the Queen the full and free right, liberty, licence, and authority in perpetuity to construct and use a right of way, with the right for Her Majesty’s servants, agents, workmen, licensees, and invitees from time to time, and at all times hereafter, to go, pass, and repass with or without horses or other animals or vehicles over the land described in the said Schedule, and to maintain, repair, and keep open the said right of way; and I also declare that this Proclamation shall take effect on and after the 21st day of February 1972.

SOUTH AUCKLAND LAND DISTRICT
ALL that piece of land containing 2 roods and 6.7 perches being part Okoheriki 1H North, Part 6B2 Block, Block XVI, Rotorua Survey District; as the same is more particularly delineated on the plan marked M.O.W. 24911 (S.O. 45392) deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.
Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 8th day of February 1972.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the appointment of the person holding, for the time being, the office of Resident Engineer, Minister of Works, Gisborne, as a non-elective member of the Poverty Bay Catchment Board, and hereby declares that the person who is the holder, for the time being, of the office of District Commissioner of Works, Napier, shall be a non-elective member of the Poverty Bay Catchment Board.

Transfer of Functions of Kaikoura County Council to Marlborough Harbour Board

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Commission Act 1967 and the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

This order shall come into force on the day after the date of its notification in the Gazette.

On the commencement of this order, all those functions exercised by the Kaikoura County Council, pursuant to section 165 of the Harbours Act 1950, shall be transferred to and exercised by the Marlborough Harbour Board.

All bylaws of the Kaikoura County Council that relate to that Council’s functions, under section 165 of the Harbours Act 1950, and are in force immediately before the commencement of this order shall continue in force after the commencement of this order as if they were made by the Marlborough Harbour Board, until bylaws are made by that Board in substitution therefor, and shall after the commencement of this order be enforceable by the Marlborough Harbour Board accordingly.

(1) On the commencement of this order, all the assets, liabilities, rights, and engagements of the Kaikoura County Council, in respect of its functions under the Harbours Act 1950 (including all the property vested in the Kaikoura County Council by paragraph (2) of the Order in Council dated the 24th day of September 1956 and published in the Gazette of that year at page 1324), that have not been disposed
