Declaring Land and an Easement of Right of Way Over Land Taken for a Horticultural Research Station in Block II, Clive Survey District, and Block XVI, Heretaunga Survey District, Hawke's Bay County

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for a horticultural research station from and after the 13th day of September 1971, and also hereby declares that an easement of right of way is hereby taken for a horticultural research station over the land described in the Second Schedule hereto, vesting in Her Majesty the Queen from and after the 13th day of September 1971, the full and free right, liberty, licence, and authority in perpetuity to construct and use a right of way, with the right of Her Majesty's servants, agents, workmen, licensees, and invitees from time to time and at all times by day and night to go, pass, or repass with or without vehicles, machinery, and implements of any kind over the land described in the Second Schedule hereto, and to maintain, repair, and keep open the said right of way for the purpose of providing access to the land described in the First Schedule hereto; and that such right of way shall be held appurtenant to the land described in the First Schedule hereto.
