Christchurch Metropolitan Fire Board Election Order 1971

IN COUNCIL
Pursuant to the Fire Services Act 1949, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, hereby makes the following order
prescribing the time and method of election of members of
the Christchurch Metropolitan Fire Board.
ORDER

  1. Title and commencement—This order may be cited as the
    Christchurch Metropolitan Fire Board Election Order 1971.
  2. Interpretation—In this order, unless the context otherwise
    requires—
    “Board” means the Christchurch Metropolitan Fire Board;
    “City Member” means a member of the Board elected to
    represent the Christchurch City Council;
    “Local Authority” means a local authority (other than the
    Christchurch City Council and the Waimairi County
    Council), the district, or part of the district, of which is
    within the Christchurch United Urban Fire District;
    “Local Authority Member”, means a member of the Board
    elected to represent the local authorities (other than the
    Christchurch City Council and the Waimairi County
    Council) represented on the Board;
    “Minister” means the Minister of Internal Affairs;
    “Waimairi County Member”, means a member of the Board
    elected to represent the Waimairi County Council.
  3. The members to be elected to the Board under paragraph
    (b) of subsection (1) of section 23 of the Fire Services Act
    1949 shall number five, of whom—
    (a) Three shall be elected by the Christchurch City Council
    to represent that Council;
    (b) One shall be elected by the Waimairi County Council
    to represent that Council;
    (c) One shall be elected jointly by the Riccarton Borough
    Council, the Lyttelton Borough Council, the Heath-
    cote County Council, and the Paparua County Council
    to represent those Councils.
  4. Returning Officer—The person for the time being holding
    office as the Secretary of the Christchurch Metropolitan Fire
    Board shall be the Returning Officer for all elections held
    pursuant to this order.
  5. Election of City Members—(i) Each city member shall be
    elected by resolution passed at a properly constituted meeting
    of the Christchurch City Council;
    (ii) Whenever an election of members to the Board is
    required to be held under section 24 of the Fire Services Act,
    the Mayor of the City of Christchurch shall convene a meet-
    ing of the Christchurch City Council for the purpose of electing
    the number of city members specified in clause 3 of this
    order to represent that Council on the Board;
    (iii) In the case of an extraordinary vacancy in the office of
    a city member the Returning Officer shall give notice in writing
    to the Christchurch City Council. On receipt of the notice by
    the Council the Mayor of the City of Christchurch shall
    convene a meeting of the Council to be held not later than 35
    days after the date when the notice was given, for the purpose
    of electing the city member to fill that vacancy;
    (iv) It shall be the duty of the Town Clerk of the Christ-
    church City Council within 5 days after the election by the
    Christchurch City Council under this order to give notice of
    the result to the Returning Officer.
  6. Election of Local Authority Member—(i) For the purposes
    of electing a local authority member, each local authority shall
    be entitled to exercise one vote for each complete $200, or
    part thereof, of the contributions paid, or to be paid, by that
    local authority, to the Board in the year in which that election
    is held;
    (ii) Each local authority may nominate one candidate by
    resolution, a sealed copy of which, together with the written
    consent of the nominee to his nomination shall be lodged with
    the Returning Officer not later than the 14th day of October
    in every year in which the election of local authority members
    is to take place;
    (iii) In the case of an extraordinary vacancy in the office of
    a local authority member the Returning Officer shall give notice
    in writing to each local authority. On receipt of the notice each
    local authority may nominate one candidate by resolution, a
    sealed copy of which, together with the written consent of the
    nominee to his nomination shall be lodged with the Returning
    Officer not later than 10 days after the Returning Officer has
    given that notice;
    (iv) On the expiration of the time for nominating candidates
    as above, the Returning Officer shall forthwith prepare a list of
    candidates and send a copy to each of the local authorities
    together with a notice in writing specifying the number of votes
    exercisable by each local authority;
    (v) Within 35 days of the receipt of the list each mayor or,
    as the case may be, chairman, of a local authority, shall cause
    a meeting of his council to be held for the purpose of allocat-
    ing the prescribed number of votes to which each local
    authority is entitled under subclause (i) of this clause. At the
    meeting the local authority shall, by resolution, allocate its
    votes in respect of only one candidate.
    (vi) Each local authority shall within 5 days of its meeting
    cause a sealed copy of the resolution to be served on the
    Returning Officer.
  7. Election of Waimairi County Member—(i) The Waimairi
    County member shall be elected by resolution passed at a
    properly constituted meeting of the Waimairi County Council;
    (ii) Whenever an election of members to the Board is
    required to be held under section 24 of the Fire Services Act
    1949, the Chairman of the Waimairi County shall convene a
    meeting of the Waimairi County Council for the purpose of
    electing the member to represent that Council on the Board;
    (iii) In the case of an extraordinary vacancy in the office of
    the Waimairi County member the Returning Officer shall give
    notice in writing of the vacancy to the Waimairi County
    Council. On receipt of the notice by the Council, the Chairman
    of the County of Waimairi shall convene a meeting of the
    Council to be held not later than 35 days after the date on
    which the notice was given for the purpose of electing a
    person to fill the vacancy;
    (iv) It shall be the duty of the County Clerk of the
    Waimairi County Council within 5 days after the election by
    the Waimairi County Council under this clause to give notice
    of the result to the Returning Officer.
  8. Powers and duties of Returning Officer—(i) In the event
    of there being an equality of votes in any election held pursuant
    to this order, the Returning Officer shall have a casting vote.
    (ii) As soon as practicable after the conclusion of any
    elections held under this order, the Returning Officer shall—
    (a) Give notice in writing of the results of the elections to
    the Minister of Internal Affairs, the Christchurch
    City Council, the Waimairi County Council, and to
    the local authorities;
    (b) Cause the results to be publicly notified in one or more
    newspapers circulating in the Christchurch Metro-
    politan Fire District.
  9. Validity of election not affected by failure to hold meet-
    ing, etc.—The validity of an election held pursuant to this order
    shall not be affected by failure of the Christchurch City
    Council, the Waimairi County Council, or any local authority—
    (a) To hold a meeting required by this order to be held by
    it; or
    (b) To pass at any such meeting a resolution allocating its
    votes; or
    (c) To forward within the period specified in this order a
    sealed copy of such resolution to the Returning
    Officer; or
    (d) Otherwise to exercise the powers conferred on it by this
    order.
  10. Time at which member deemed to be elected—(a) Every
    city member and Waimairi County member shall be deemed to
    be elected when the notice of his election is given by the
    Christchurch City Council, and the Waimairi County Council
    to the Returning Officer.
    (b) The local authority member shall be deemed to be
    elected when the Returning Officer has notified the result of the
    election in accordance with clause 8 (ii) (a) of this order.
