FIRST SCHEDULE
DESCRIPTION OF AREA
THAT portion of the foreshore commencing at the westernmost point of the southern bank of the Waikanae River and extending generally south-westerly to the arc of a circle with radius of 1.75 nautical miles centred at peg XXIV on the western boundary of Lot 23, D.P. 2093, in Block VIII, Paekakariki S.D. (such arc being the northern seaward limit of the harbour of Porirua, as described in Gazette 1969, p. 609).
SECOND SCHEDULE

Her Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, over, and out of the foreshore described in the First Schedule to this order without payment.

Nothing in this order shall authorise the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs or any provision of the Harbours Act 1950 that is or may hereafter be in force.

The rights, powers, and privileges conferred by this order shall not apply to those portions of the foreshore described in the First Schedule to this order required for securing the shore ends of any telegraph cables that are at the commencement of this order or may be at any time subsequently laid down within that foreshore.

The Council may enclose any part or parts of the foreshore described in the First Schedule to this order for the purpose of holding sports meetings or games, and may, by bylaws, fix a charge for admission to any such enclosed part or parts:
Provided that the total number of days on which any particular part of that foreshore is so enclosed shall not exceed six in any one calendar year.

Nothing in this order shall authorise the Council to remove or cause to be removed from the foreshore described in the First Schedule to this order any stone, sand, shingle, or shells without the consent in writing of the Minister being first obtained.

The powers, functions, duties, and authorities conferred on the Council by this order may be at any time resumed by the Governor-General, without payment or any compensation whatever, on giving to the Council at least six calendar months' notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the Council at its public office.

Boundaries of County of Whakatane and Borough of Kawerau Altered
ORDER IN COUNCIL
At the Government Buildings at Wellington this 13th day of October 1969
Present:
THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL
PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order shall come into force on 1 January 1970.

The area described in the Schedule hereto is hereby excluded from the County of Whakatane and included in the Borough of Kawerau.

The alteration of the boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1954.
SCHEDULE
ALL that area in the South Auckland Land District, Whakatane County, containing 462 acres, more or less, bounded by a line commencing in Block XVI, Rotoma Survey District (north), on the left bank of the Tarawera River, as shown on S.O. Plan 44040, at the easternmost corner of part Kawerau B. Block, and proceeding along a right line to the south-western corner of Allotment 498, Matata Parish; thence along the generally western boundaries of Allotments 498 and 499, Matata Parish,
to a peg bearing 236° 40', distant 20.8 links from I.S. XV (S.O. Plan 44228); thence along a series of right lines bearing 294° 51', distance 986.4 links; 317° 27' 40", 2,469.4 links; 323° 50', 1,408.8 links; 1° 09' 20", 3,606.4 links; and 54° 46' 10" to the left (eastern) bank of the Ruruanga Stream; thence south-easterly generally along that bank to a point bearing 320° 42' from peg XXI A. on S.O. Plan 33006; thence to that peg; thence along right lines bearing 123° 13', distance 415.9 links, and bearing 161° 47' 30", distance 112.0 links; thence along a right line to the westernmost corner of part Lot 1, D.P. S. 5882; thence westerly generally along the north-western boundary of Lot 157 and the northern boundaries of Lots 8 and 9, all on D.P. S. 8969, to the westernmost corner of the last-named lot; thence southerly along the western boundary of Lot 9, aforesaid, the western end of River Road, and the western boundary of Lot 154, D.P. S. 8969, to the south-western corner of the last-named lot; thence along a series of right lines, bearing 268° 04', distance 115 links; 189°, 440 links; 208°, 162 links; 194°, 430 links; 185°, 470 links; 162°, 190 links; 150°, 110 links; 140°, 108 links; 132°, 220 links; 110° 30', 90 links; 199°, 185 links; 189°, 106 links; 184° 30', 428 links; 120°, 155 links; and 128° 30' to the left bank of the Tarawera River; thence south-westerly generally along that bank to the point of commencement.

Officers of Government of Ross Dependency Appointed
ARthur PORRITT, Governor-General
WHEREAS, by the Order in Council dated the 30th day of July 1923*, made under the British Settlements Act 1887 of the United Kingdom Parliament, the Governor-General and Commander-in-Chief of New Zealand for the time being (therein and hereinafter called the Governor) was appointed to be the Governor of the Ross Dependency, and all the powers and authorities which by the said order were given and granted to the Governor for the time being of the Dependency were thereby vested in him;
And whereas the Governor was thereby further authorised and empowered to make all such rules and regulations as might lawfully be made by Her Majesty's authority for the peace, order, and good government of the Dependency;
And whereas, by regulations made by the Governor on the 14th day of November 1923†, it was enacted that all persons appointed by the Governor for the time being of the Dependency should have such power and authority as might be granted them in due course of law, and might be empowered to do such things as might be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty's rights and sovereignty over and in respect of the Dependency;
And whereas it is expedient that the persons hereinafter named be appointed officers of the Government of the Dependency:
Now, therefore, I, Sir Arthur Espie Porritt, Baronet, the Governor-General of New Zealand, and as such the Governor of the Ross Dependency, hereby appoint
Robert Bruce Willis, Esq.
as an officer of the Government of the Dependency; and I hereby confer on him all the powers and authorities which may be exercised in New Zealand by a Justice of the Peace, and also the powers and authorities which may be so exercised by a Coroner.
And I also appoint
Robert James Hancock, Esq.
as an officer of the Government of the Dependency; and I hereby confer on him all the powers and authorities which may be exercised in New Zealand by a Postmaster.
The said Robert Bruce Willis and Robert James Hancock to exercise their functions at such places within the Dependency as may be directed by the officer for the time being appointed as an officer of the Government of the Dependency in whom is vested the general executive and administrative authority in preserving Her Majesty's rights and sovereignty and the laws and regulations in force in the Dependency; and to hold office and exercise the duties thereof during pleasure.
As witness the hand of His Excellency the Governor-General, as the Governor of the Ross Dependency, this 8th day of October 1969.
