At the Government House at Wellington this 6th day of October 1969

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Ashburton County Council stopping the portions of road described in the Schedule hereto.

CANTERBURY LAND DISTRICT

ALL those pieces of road in Block II, Westerfield Survey District, Canterbury R.D., described as follows:

A. R. P. Adjoining or passing through
5 1 11.2 Lot 2, D.P. 1044.
0 1 18.7 Part bed of Ashburton River, south branch.

As the same are more particularly delineated on the plan marked M.O.W. 23612 (S.O. 11249) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Declaring Road in Block IV, Lower Hāwea Survey District, to be a Government Road and to be Stopped

At the Government House at Wellington this 22nd day of September 1969

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby

(a) declares the pieces of road described in the Schedule hereto to be a Government road; and

(b) stops the said road.

OTAGO LAND DISTRICT

ALL those pieces of road situated in Block IV, Lower Hāwea Survey District, Otago R.D., described as follows:

A. R. P. Adjoining or passing through

0 1 37 Part Section 28, Section 30, and Lot 251, D.P. 6712, being part Sections 25 and 29.

Redefining the Limits of the Harbour of Tauranga

ORDER IN COUNCIL

At the Government House at Wellington this 29th day of September 1969

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 3 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby redefines the outward seaward limits of the harbour of Tauranga to be as described in the First Schedule to this order and defines the inward limits of the harbour of Tauranga to be as described in the Second Schedule to this order.

The Warrant of 14 April 1960* defining the outward seaward limits for the harbour of Tauranga is hereby revoked.

FIRST SCHEDULE

DESCRIPTION OF OUTWARD SEAWARD LIMITS

Katikati Harbour

AN arc of a circle of 2 nautical miles radius commencing from a position a right line 341° from Trig. Station No. 69, Block 13, Katikati Survey District, continuing to the Bay of Plenty and thence to the landward boundary of the foreshore at Matakana Island, having as its centre Trig. Station No. 69, Block 13, Katikati Survey District.

Tauranga Harbour

AN arc of a circle of 2 nautical miles radius running from the landward boundary of the foreshore on Matakana Island, and thence into the Bay of Plenty to a position intersection of a right line with North Rock Light, bearing 273°; thence to North Rock Light; thence in a 180° direction to the landward boundary of the foreshore, and having as its centre Trig. Station A., Mount Maunganui, Block 6, Tauranga Survey District.

Maketu and Waihi Estuaries

A right line commencing from Maketu Trig. Station F., in a 295° ¼ mile thus to enclose the Maketu Estuary, and a right line commencing at Maketu Trig. Station F. in a 075° direction ¾ mile, thus to enclose the Waihi Estuary.

SECOND SCHEDULE

DESCRIPTION OF INWARDS LIMITS

  1. The waters of the Wairoa River downstream of the seaward side of the Wairoa Bridge of State Highway No. 2; and

  2. All tidal water within the limits defined in the First Schedule to this order; excepting thereout the Wairoa River, the inward limit of which is defined in paragraph 1 of the Second Schedule to this order.

The Hutt County Foreshore Control Order 1969

At the Government House at Wellington this 6th day of October 1969

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Hutt County Foreshore Control Order 1969.

(2) This order shall come into force from the date of its publication in the Gazette.

  1. In this order—

“Council” means the Hutt County Council:

“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides:

“Minister” means the Minister of Marine and includes any officer, person, or authority acting by or under the direction or authority of the Minister.

  1. There is hereby granted to the Council for a period of 21 years from the commencement of this order the control of the foreshore described in the First Schedule to this order, subject to the provisions of section 165 of the Harbours Act 1950 and to the conditions specified in the Second Schedule to this order.

  2. The following Orders in Council are hereby revoked:

(a) The Order in Council made on the 8th day of October 1952*, granting to the Council the control of the foreshore described in the First Schedule to that order.

(b) The Order in Council made on the 21st day of October 1953†, amending the order referred to in paragraph (a) of this clause.
