At the Government Buildings at Wellington this 3rd day of February 1969

RIGHT HON. J. R. MARSHALL PRESIDING IN COUNCIL

PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Matamata County Council stopping the portion of road described in the Schedule hereto.

ALL that portion of road containing 2 roods 4.2 perches situated in Block III, Patetere South Survey District, adjoining or passing through Lot 3, D.P. S. 6653, Block XV, Patetere North Survey District; as the same is more particularly delineated on the plan marked M.O.W. 22946 (S.O. 44396) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

The Upper Waitaki Extension Irrigation District Order 1969

ORDER IN COUNCIL

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to section 274 of the Public Works Act 1928 and Part I of the Public Works Amendment Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. This order may be cited as the Upper Waitaki Extension Irrigation District Order 1969.

  2. The Minister of Works is hereby authorised to construct, maintain, and control the water supply works described in the First Schedule hereto to serve the district described in the Second Schedule hereto.

  3. The area of land described in the said Second Schedule is hereby constituted as an irrigation district, to be known as the Upper Waitaki Extension Irrigation District (herein referred to as “the district”).

  4. It is hereby declared that the water quota shall be 22 in. over the land in the district commanded by supply points and not exempted pursuant to section 13 of the Public Works Amendment Act 1960.

  5. It is hereby declared that the irrigation charge which will be payable for half the water quota shall be $4.10 per acre of land in the district commanded by supply points and not exempted as aforesaid, reducible over the first nine irrigation seasons of supply to the charges set out in the Third Schedule hereto.

  6. It is hereby declared that the charge which will be payable for such water as may be supplied in excess of half the water quota but not in excess of the total water quota shall be at the rate of $2.30 per acre-foot.

FIRST SCHEDULE

WATER SUPPLY WORKS

The Upper Waitaki Extension Irrigation Works (for the irrigation of the district) by means of water drawn from Lake Waitaki and the Awakino River and from any dam or dams which are or may be constructed or acquired on the said lake or river or any other river or stream, such water being conveyed into the district by a race or races constructed or acquired by the Minister of Works, or by any enlargement or extension thereof; the said works, including all dams, weirs, reservoirs, tunnels, fluming, siphons, piping, gauge boxes, and races, and all other works incidental to or required for the construction, maintenance, and control of the said works for the irrigation of the District.

SECOND SCHEDULE

UPPER WAITAKI EXTENSION IRRIGATION DISTRICT

ALL that area in the Otago Land District, Waitaki County, containing 3,100 acres, more or less, bounded by a line commencing at Trig. Station Black Hill, situated on the eastern boundary of Block XII, Maerewhenua Survey District, and proceeding northerly along that boundary to the north-eastern side of State Highway No. 83; thence generally south-
