Counties of Ashley and Kowai United Under Name of County of Ashley

ORDER IN COUNCIL
At the Government Buildings at Wellington this 22nd day of April 1968
Present:
HON. J. R. HANAN, PRESIDING IN COUNCIL
PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on 1 May 1968.
  2. The districts of the counties of Ashley and Kowai are hereby united and the councils of the said counties are hereby dissolved.
  3. The united district shall be called the County of Ashley (hereinafter called the “said county”).
  4. For representation purposes only the said county shall be divided into 5 ridings as follows:
    (i) The North Riding, comprising the North Riding of the former County of Kowai;
    (ii) The Amberley Riding, comprising the Amberley Riding of the former County of Kowai;
    (iii) The South Riding, comprising the South Riding of the former County of Kowai;
    (iv) The Mount Thomas Riding, comprising the Mount Thomas Riding of the former County of Ashley; and
    (v) The Loburn-Whiterock Riding, comprising the Loburn-Whiterock Riding of the former County of Ashley.
  5. The Council of the said county shall consist of 12 members with representation as follows:
    For the North Riding ..... 3 members
    For the Amberley Riding ..... 1 member
    For the South Riding ..... 3 members
    For the Mount Thomas Riding ..... 2 members
    For the Loburn-Whiterock Riding ..... 3 members
  6. The first election of the members of the Council of the said county shall be held on the date prescribed by law for the triennial election of members of county councils next following the constitution of the said county.
  7. Until the members of the Council of the said county to be elected shall come into office, the Council shall consist of 14 members as follows:
    (a) The seven members of the former Ashley County Council, and
    (b) The seven members of the former Kowai County Council.
  8. For a period not exceeding 10 years, for the purposes hereinafter provided, the said county shall be divided into two divisions as follows:
    (i) The Ashley Division comprising the district of the former County of Ashley;
    (ii) The Kowai Division comprising the district of the former County of Kowai.
  9. For a period not exceeding 10 years, separate accounts shall be kept for each such Division and for rating purposes the said county shall operate under the provisions of section 110 (1) of the Counties Act 1956.
  10. The following items in the accounts of the former Counties of Ashley and Kowai shall be credited and debited respectively to the General and Separate Accounts and Funds of the said county:
    (a) All credit balances other than those hereinafter specifically mentioned.
    (b) All assets other than those hereinafter specifically mentioned.
    (c) All liabilities of the former Counties of Ashley and Kowai other than those hereinafter mentioned.
  11. The following items in the accounts of the former Counties of Ashley and Kowai shall be credited and debited respectively to the Division Accounts of the Ashley and Kowai Divisions:
    (a) General cash balances.
    (b) Public debt and contingent liabilities.
  12. Except as otherwise provided herein or in the Local Government Commission Act 1967, the provisions of section 10 of the Counties Act 1956 shall apply to the union of counties hereby effected as if the former Counties of Ashley and Kowai had been united under that Act.
  13. All existing staff of the councils of each of the former counties shall be taken over by the council of the said county under and subject to the provisions of the Local Authorities (Employment Protection) Act 1963. This provision shall be in extension of and subject to the provisions of the said Act.
  14. The County Clerk of the former County of Ashley shall be responsible for calling the first meeting of the Council of the said county.
  15. So far as they are applicable and with the necessary modifications, the provisions of section 99A of the Land Transfer Act 1952 shall apply to the union hereby effected.
