Consenting to an Easement over Land Being Taken for the Auckland Harbour Bridge in the Borough of Northcote

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the right of way easement described in the First Schedule hereto being taken for the Auckland Harbour Bridge over the land described in the Second Schedule hereto.
FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
Description of Easement
AN easement in gross in perpetuity (and without in any way limiting or detracting from the easements created by transfers Nos. 599017 and 604211) being a right of way over all those parcels of land first, secondly, thirdly, fourthly, fifthly sixthly, and seventhly described in the Second Schedule hereto and the air space above the same to a height of not more than 150 feet above sea level, and for that purpose the following liberties and licences that is to say:
The full and free right, liberty, and licence to erect and maintain a viaduct over the said parcels of land and also over the parcels of land eighthly, ninthly, and tenthly described in the said Second Schedule (such land eighthly and ninthly described being subject to the easement created by transfer No. 599017 and such land tenthly described being subject to the easement created by transfer No. 604211) and to construct and maintain such piers to support the said viaduct as are delineated and defined on plan S.O. 45529 and to construct a roadway on the said viaduct for the use of the public which said viaduct piers and roadway are herein called “the said structures”, and for the purposes aforesaid or for any of them from time to time and at all times as occasion shall require for the Auckland Harbour Bridge Authority by itself, its contractors and sub-contractors, and its and their servants, agents, and workmen to enter with or without horses and vehicles, laden or unladen, and with derricks, machinery, and tools upon all the land described in the said Second Schedule, and for the purposes aforesaid to erect all plant, erections, and works, whether permanent or temporary, thereon, and to view the state and condition thereof or any part or parts thereof and to maintain, renew, conserve, and/or repair the said structures or any part thereof subject to the following conditions:
(a) That each owner of the land hereinafter described, his executors, administrators, and assigns, will not at any time make any erections thereon without the previous consent in writing of the Auckland Harbour Bridge Authority provided always that such consent shall not to be unnecessarily or unreasonably withheld;
(b) That each owner of the land hereinafter described, his executors, administrators, and assigns, will refrain from doing anything thereon that might in the opinion of the Auckland Harbour Bridge Authority tend to endanger the foundations of the said structures or their supports; and
(c) That the Auckland Harbour Bridge Authority, its successors and assigns, will restore the surface of the land hereinafter described with the exception of the bases of any piers erected thereon to the condition in which the said land was before the commencement of the said work, and shall keep the same in good and clean condition.

Boundaries of County of Amuri, County of Awatere, and County of Marlborough, Altered

PURSUANT to the Local Government Commission Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- This order shall come into force on 1 April 1968.
- The areas described in the First Schedule hereto are hereby excluded from the County of Amuri and included in the County of Awatere.
- The area described in the Second Schedule hereto is hereby excluded from the County of Amuri and included in the County of Marlborough.
- The area described in the Third Schedule hereto is hereby excluded from the County of Marlborough and included in the County of Awatere.
- The boundary alterations hereinbefore made shall be deemed to have been effected under the Counties Act 1956.
FIRST SCHEDULE
FIRSTLY: All that area in the Nelson, Marlborough, and Canterbury Land Districts, bounded by a line commencing at Mount Maling, on the watershed between the Clarence and Wairau Rivers in Block XIII, Rainbow Survey District, and proceeding generally easterly along the southern watershed of the Wairau River, passing through Island Pass, Mount Balaclava, to Mount Tarndale in Block XVI, Rainbow Survey District; thence generally north-easterly along the south-eastern watershed of the Wairau River, through Trig. Station F to the junction in Block IV, Wairau Survey District with the western boundary of Run 226 (Molesworth); thence northerly, north-easterly and generally south-easterly along the western, north-western and north-eastern boundaries of the said Run 226 to the intersection in Block XIII, Molesworth Survey District, with a right line between Trig. Station Top 2 in Block XI, Motupiko Survey District, and Barefell Pass in Block III, Severn Survey District; thence south-easterly along the said right line to Barefell Pass; thence generally south-westerly along a right line to the source of the Guide River and down the middle of the Guide and Acheron Rivers to the confluence of the Acheron and Clarence Rivers; thence generally westerly, southerly, westerly, and northerly up the middle of the Clarence River to the southern shore of Lake Tennyson; thence generally northerly along the eastern shore of Lake Tennyson to a point in line with the north-western boundary of Tarndale Run; thence north-easterly to and along the said boundary to the summit of the watershed between the Wairau and Clarence Rivers near Mount Maling; thence south-easterly along the said watershed to Mount Maling, the point of commencement. Area, 225,700 acres, more or less.
Secondly: All that area in the Marlborough Land District bounded by a line commencing at the confluence of the Acheron and Clarence Rivers in Block XIII, Acheron Survey District, and proceeding easterly and northerly down the middle of the said Clarence River to its intersection in Block XX, Acheron Survey District, with a right line joining the confluence of the Acheron and Clarence Rivers and Palmer Saddle in Block XVI, Acheron Survey District; thence generally westerly along the said right line to the confluence of the Acheron and Clarence Rivers, the point of commencement. Area, 6,800 acres, more or less.
SECOND SCHEDULE
ALL that area in the Nelson and Marlborough Land Districts bounded by a line commencing at Mount Maling in Block XIII, Rainbow Survey District, and proceeding generally northerly along the summit of the St. Arnaud Range through Belvedere Peak, Mount Mackay, Mount Cotterell, The Camel and St. Arnaud Trig. to the south-eastern boundary
