The Buller Electric Power Board Water Power and Electric Lines Licence 1967

THE RIGHT HON. KEITH HOLYOAKE, C.H., PRESIDING IN COUNCIL

PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:


ORDER

  1. This order may be cited as the Buller Electric Power Board Water Power and Electric Lines Licence 1967.

  2. Subject to the conditions hereinafter set forth, the Buller Electric Power Board (hereinafter referred to as “the licensee”) is hereby granted a licence to obstruct, impound, or divert the waters of Christmas Creek, Lake Creek, and Lake Rochfort (hereinafter referred to as “the said waters”) to raise or lower the levels thereof, and to take and use therefrom, for the purpose hereinafter set forth, streams of water (hereinafter referred to as “the said streams”) not exceeding 60 cu. ft. per second at any one time from Christmas Creek, 60 cu. ft. per second at any one time from Lake Creek, and 30 cu. ft. per second at any one time from Lake Rochfort, and also to lay, construct, put up, place, and use electric lines and to construct electric works which may from time to time be required for the distribution and supply of electricity within the area described in the First Schedule hereto.

  3. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electric Supply Regulations 1967 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  4. This licence is subject to the Water Power Regulations 1934, the Electrical Supply Regulations 1967, the Electrical Wiring Regulations 1961, and the Radio Interference Regulations 1958, and to all regulations made in amendment thereof, or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  5. The said streams shall be taken from the said waters at the points indicated by red lines on the plan marked N.Z.E.D. 738 deposited in the office of the New Zealand Electricity Department at Wellington, and shall be used solely for the purpose of generating electricity.

  6. The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the position of the said works being indicated on the said plan.

  7. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), and (h) of regulation 15 of the Electric Supply Regulations 1967.

  8. Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.

  9. This licence shall, unless sooner lawfully determined, continue in force until the 23rd day of February 1988.


FIRST SCHEDULE

AREA OF SUPPLY

The Buller Electric Power District, as described in the Third Schedule to the Proclamation dated the 14th day of April 1959 and published in the Gazette on the 23rd day of the same month at page 517.


SECOND SCHEDULE

Headworks consisting of dams and necessary intakes, pipe-line, races, or flumes leading directly or indirectly from such intakes to the powerhouse, such powerhouse having all necessary equipment including water turbines, generators, transformers, lightning arresters, switchboards, switches, exciters, and other appliances for generating electricity.

Amending the Otago Electric Power Board Electric Lines Licence 1953

PURSUANT to the Public Works Act 1928 and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:


ORDER

  1. This order may be cited as the Otago Electric Power Board Electric Lines Licence 1953, Amendment No. 5, and shall be read together with and deemed part of the Otago Electric Power Board Electric Lines Licence 1953* (hereinafter referred to as “the principal order”), which said order was amended by Order in Council dated the 2nd day of May 1955, and published in the Gazette on the 5th day of the same month at page 734, and by Order in Council dated the 28th day of January 1959, and published in the Gazette on the 5th day of February 1959, at page 105, and by Order in Council dated the 21st day of July 1965, and published in the Gazette on the 29th day of the same month at page 1205, and by Order in Council dated the 25th day of January 1967, and appearing in the Gazette on the 16th day of February 1967, at page 220.

  2. The principal order is hereby amended by deleting clause 4 thereof and substituting the following:

“4. This licence shall, unless it is sooner lawfully determined, continue in force until the 10th day of April 1968.”
