The Standards Act 1965—New Zealand Standard Recommendation Adopted

Pursuant to the Standards Act 1965, the Standards Council,
on 27 July 1967, approved the issue of the under-mentioned
standard recommendation:

The Indecent Publications Act 1963

In the matter of the Indecent Publications Tribunal and in
the matter of a charge against J. and J. Joyce Ltd., alleging
the sale of two booklets Sam the Ceiling Needs Painting and
Around the World with Sam which it was claimed were
indecent.

DECISION OF THE TRIBUNAL

The prosecution was brought in the Magistrate's Court at
Auckland, and the Magistrate decided to refer the question
as to whether the booklets were indecent to the Tribunal.
At the hearing before the Tribunal the Crown Solicitor
(Mr Birks) appeared in support of the prosecution and Mr
Hardie Boys appeared for the defendant.

Apparently the booklets have been sold quite widely in
America, Scandinavia, Italy, and Holland, where sales have
amounted to 150,000—in New Zealand to over 20,000. The
booklets have been widely sold in New Zealand.

It was contended on behalf of the prosecution that the
booklets exhibited a vulgarity amounting to indecency and
would tend to debase the community, in so far as they
treated sexual intercourse in a frivolous way, and there
were references to incest, bestiality, and sodomy. It was
claimed they had no redeeming value.

For the defence it was contended they were inconsequential
and that such levity as was shown regarding sexual inter-
course was unlikely to have any influence on teenagers. There
are some passages which are witty and there is some element
of humour.

On an overall consideration of the booklets the Tribunal
finds them clever and amusing, and not indecent in the
hands of adults; but because the booklets deals in a trivial
and vulgar manner with sex not only in its normality, but
in its gross and criminal aberrations, they appear to us to
be undesirable in tone for younger teenagers who could
well draw debasing inferences from them. The Tribunal
therefore holds these two booklets to be indecent in the
hands of persons under the age of 16 years.
