Declaring Land in Otago Land District, Vested in the Otago Education Board as a Site for a Public School, to be Vested in Her Majesty the Queen

A PROCLAMATION

PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Otago Education Board as a site for a public school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

PURSUANT to section 18 of the Forests Act 1949, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby set apart the Crown land described in the Schedule hereto as provisional State forest land.

Commission to Inquire into Disaster at Strongman Mine

ORDER IN COUNCIL

To all to whom these presents shall come, and to:

JOHN KENNETH PATTERSON, Esquire, Stipendiary Magistrate;
WILLIAM ELLIOTT, Mine Underviewer;
STANLEY ROBERT EYEINGTON, Mine Manager;
THOMAS McGHIE, M.B.E., Retired District Manager of State Coal Mines, and
ANTONIO VALLI PRENDIVILLE, President, United Mine Workers:

GREETING:

WHEREAS it is deemed expedient that an inquiry should be made into the cause of the disaster which occurred at the Strongman State Coal Mine, Greymouth, on the 19th day of January 1967, and matters incidental thereto:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said John Kenneth Patterson, William Elliott, Stanley Robert Eyeington, Thomas McGhie, and Antonio Valli Prendiville to be a Commission to inquire into and report upon—

(a) The cause of the disaster in the Strongman State Coal Mine on the 19th day of January 1967:
(b) The nature and character of the working and the efficiency of the management of the mine:
(c) The efficiency of the inspection of the mine by all or any of the persons who are responsible for that inspection:
(d) Suggestions for the prevention, as far as possible, of similar disasters and for the safe working of this and other mines in the future—

and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and to report upon any matters affecting the premises which you consider should be brought to the attention of the Government, and in particular, to report your opinion whether any additional legislation is necessary and the scope of the same, and whether the regulations included in the existing law provide for reasonable and proper safeguards against similar disasters, or whether any amendment or addition to them is required:

And with the like advice and consent I hereby appoint you, the said John Kenneth Patterson, to be the Chairman of the said Commission:

And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you deem expedient, with power to adjourn from time to time and from place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, except to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers hereby conferred on you except such evidence or information as is received in the course of a sitting open to the public:

And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one member of the Commission hereby appointed, so long as the Chairman and one other member are present and concur in the exercise of such powers:

And it is hereby further declared that you have liberty to report your proceedings and recommendations under this Commission from time to time if you shall judge it expedient so to do:

And, using all due diligence, you are required to report to me in writing under your hands not later than the 1st day of August 1967 your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.
