Pursuant to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- This order may be cited as the Taupo Borough Council Water Power and Electric Lines Licence 1965.
- Subject to the conditions hereinafter set forth, the Taupo Borough Council (hereinafter referred to as the licensee) is hereby granted a licence to obstruct, impound, or divert the water of the Hinemaiaia Stream (hereinafter referred to as the said stream) situated in Tauhara South B Block and Pahikohuru Nos. 3, 4, and 6 Blocks, Blocks II and VI, Waitahanui Survey District, in the County of Taupo, and to take and use therefrom, for the purpose hereinafter set forth (Hinemaiaia A scheme), a stream of water not exceeding 300 cu. ft. per second, and also to obstruct, impound, or divert the waters of the said stream in Section 1, Opawa Rangitoto Block, Block I, Waitahanui Survey District, and to take and use therefrom, for the purpose hereinafter set forth (Hinemaiaia B scheme), a stream of water not exceeding 300 cu. ft. per second, and also to lay, construct, put up, place, and use electric lines within the area of supply described in the First Schedule hereto.
- The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.
- This licence is issued under the Water Power Regulations 1934 and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.
- (a) The water for the Hinemaiaia A scheme shall be taken from the said stream at a point in Tauhara South B Block and Pahikohuru No. 6 Block, Block III, Waitahanui Survey District, as indicated on the plans marked S.H.D. 178 and 179, respectively, deposited in the office of the New Zealand Electricity Department at Wellington.
(b) The water for the Hinemaiaia B scheme shall be taken from the said stream at a point in Section 1, Opawa Rangitoto Block, Block 1, Waitahanui Survey District, as indicated on the plan marked N.Z.E.D. 643 deposited in the office of the New Zealand Electricity Department at Wellington.
The water shall be used solely for the purpose of generating electricity. - The licensee is hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the position of the said works being indicated on the said plans S.H.D. 179 and N.Z.E.D. 643 deposited as aforesaid.
- The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), and (j) of regulation 21-01 of the Electrical Supply Regulations 1935. The system of supply authorised under paragraph (j) aforesaid shall be a single-conductor earth-return system at a voltage of 11,000 V. The use of the earth-return system of supply shall be subject to such terms and conditions as are from time to time laid down by the General Manager of the New Zealand Electricity Department.
- Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.
- This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1979.
- The Orders in Council referred to in the Third Schedule hereto are hereby revoked.
FIRST SCHEDULE
AREA OF SUPPLY - The Town District of Taupo as constituted on the 3rd day of March 1952, and Blocks II, IV, and V, Tuhingamata East Survey District, Blocks XIII, XIV, and XV, Tatua Survey District, Blocks I, II, III, V, VI, VII, X, XI, XII, XIV, and XV, Tauhara Survey District, Blocks I, II, and III, Waitahanui Survey District, and those portions of Blocks V, VI, and VII, Waitahanui Survey District, which are north of an east-west line drawn 300 chains south of the northern boundary of the Waitahanui Survey District, all in the county of Taupo.
- All that area in the South Auckland Land District, being portions of the Taupo and Rotorua Counties, bounded by a line commencing at a point on the northern shores of Lake Taupo, such point being also the southernmost extremity of the north-western boundary of Block II, Tuhingamata East Survey District; thence north-easterly along the said north-western boundary to the northern boundary of Block II, aforesaid; thence easterly along the said northern boundary and the northern boundaries of Blocks XIII, XIV, and XV, Tatua Survey District, to the eastern boundary of the last-mentioned block; thence southerly along the said eastern boundary and the eastern boundary of Block III, Tauhara Survey District, to a point being the intersection of the last-mentioned boundary with a straight line between Trig. 42 Tauhara, in Block III, Tauhara Survey District, aforesaid, and Trig. F Tiritiri, in Block III, Heruiwi Survey District; thence easterly along the said straight line to the north-western boundary of State forest reserve in Block II, Otukotara Survey District; thence north-easterly along the said north-western boundary to and along the eastern boundary of the Rotorua County as defined in Gazette, No. 23, of 20 April 1950, at page 471, to the northern boundary of Block XII, Takapau Survey District; thence westerly along the northern boundaries of Blocks XI, X, and IX, Takapau Survey District, to the western boundary of the Rotorua County as hereinbefore described, being the middle of the Waikato River; thence south-westerly generally up the middle of the said river to the eastern boundary of Block XII, Tatua Survey District; thence northerly along the eastern boundaries of Blocks XII and VIII, Tatua Survey
