Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbits Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

  1. (1) This order may be cited as the Ashburton Rabbit District Order 1965.

(2) This order shall come into force on the day after the date of its notification in the Gazette.

  1. The boundaries of the Ashburton Rabbit District, which was constituted by Order in Council on the 17th day of December 1958,* are hereby altered and redefined and, as from the commencement of this order, the boundaries of the said district shall be those specified in the Schedule hereto.

SCHEDULE

BOUNDARIES OF THE ASHBURTON RABBIT DISTRICT

ALL that area in the Canterbury Land District, Ashburton County and Borough of Ashburton, containing 758,500 acres, more or less, bounded by a line commencing at a point on the sea coast in the middle of the mouth of the Rakaia River and proceeding north-westerly up the middle of the main stream of that river to a point in line with the south-eastern boundary of Rural Section 36983, Block VI, Hutt Survey District; thence south-westerly to and along that boundary and its production to the middle of Double Hill Road; thence north-westerly along the middle of that road to a point in line with the southern boundary of Rural Section 33501; thence westerly to and along that boundary to the eastern boundary of Run 277, “Mt. Hutt”; thence southerly generally along the generally eastern boundary of that run to the northernmost corner of Rural Section 36497; thence south-westerly generally along the generally south-eastern boundary of Rural Section 36497 and the south-eastern boundary of Rural Section 32444 and its production to the middle of McLennans Bush Road; thence north-westerly along the middle of that road to a point in line with the south-eastern boundary of Rural Section 30917; thence south-westerly and north-westerly to and along the south-eastern and south-western boundary of that section to the south-eastern boundary of Reserve 2713; thence south-westerly along that boundary and its production to the middle of Pudding Hill Stream; thence south-easterly down the middle of that stream to a point in line with the middle of a road passing through Reserve 1116, Block I, Spaxton Survey District; thence south-westerly to and along the middle of that road and its production to the middle of the north branch of the Ashburton River; thence south-easterly down the middle of that river to the middle of No. 72 State Highway (Woodend-Winchester); thence south-westerly generally along the middle of that highway to a point in line with the middle of Brothers Road; thence westerly and southerly generally along the middle lines of Brothers Road and Upper Downs Road to the middle of Hinds Gorge Road; thence north-westerly along the middle of Hinds Gorge Road to the south-eastern boundary of Run 107; thence south-westerly generally along that boundary and its production to the middle of the Rangitata River; thence south-easterly generally down the middle of that river to the middle of Arundel Road; thence easterly along the middle of that road to the middle of Rangitata River Road; thence south-easterly generally along the middle lines of that road, Ealing-Coldstream Road, Hinds-Rangitata Mouth Road, and the production of the last-mentioned middle line to the south-eastern side of Lower Beach Road; thence along a right line to the northernmost corner of Rural Section 32552; thence south-easterly along the north-eastern boundary of that section and its production to the sea coast; thence north-easterly along the sea coast to the point of commencement.

Granting Control of the Waters Fronting Beachlands - Te Puru and Omana-Maraetai to the Manukau County Council

ORDER IN COUNCIL

At the Government House at Wellington this 2nd day of June 1965

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 8 (A) of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to the Manukau County Council (hereinafter called the Council) control of the waters as described in the First Schedule hereto subject to the terms and conditions set forth in the Second Schedule hereto.


FIRST SCHEDULE

FIRSTLY, all that area of tidal water in the Tamaki Strait bounded by a line commencing at a point in Block IV, Otahuhu Survey District, with coordinates of 508 N, 95728 E; thence proceeding along a right line bearing 85° 57′ for a distance of 117·67 chains to a point 1766 N, 113450 E; thence due south for a distance of 13·5 chains to the mean high-water mark of the said Tamaki Strait; thence westerly generally along the shores of that strait to a point 1975 S, 97080 E; thence along a right line bearing 331° 26′ for a distance of 28·27 chains to the point of commencement; all the above coordinates being in links and measured from Mount Eden.

As the same is shown delineated in blue on sheet 1 of plan marked M.D. 11911, and deposited in the office of the Marine Department at Wellington.

Secondly, all that area of tidal water in the Tamaki Strait bounded by a line commencing at a point in Block I, Wairoa Survey District, on the shore of the said Tamaki Strait with coordinates of 416 N, 113450 E; thence proceeding along a right line due north for a distance of 13·5 chains to a point 1766 N, 113450 E; thence easterly along a right line bearing 85° 57′ for a distance of 77·25 chains to a point 2313 N, 121156 E; thence south-easterly along a right line bearing 1180° 34′ for a distance of 77·87 chains to a point 1410 S, 127995 E; thence south-easterly along a right line bearing 130° 06′ to a point 3478 S, 130451 E; thence south-westerly along a right line bearing 220° 06′ for a distance of 7 chains to the mean high-water mark of the shore of the said Tamaki Strait; thence north-westerly and westerly along the shores of that strait to the point of commencement; all the above coordinates being in links and measured from Mount Eden.

As the same is shown delineated in blue on sheet 2 of plan marked M.D. 11911, and deposited in the office of the Marine Department at Wellington.


SECOND SCHEDULE

CONDITIONS

  1. In these conditions the term—

“Minister” means the Minister of Marine as defined by the Shipping and Seamen Act 1952 and includes any officer, person, or authority acting by or under the direction of such Minister:

“Act” means the Harbours Act 1950:

“Council” means the Manukau County Council.

  1. The concessions and privileges conferred by this Order in Council shall extend and apply only to those parts of the waters as described in the First Schedule hereto.

  2. Her Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, over, and out of the said waters without payment.
