  1. Nothing herein contained shall authorise the Council to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are or may hereafter be in force.

  2. Subject to the provisions of section 8 (A) of the Act, the Council for and within the area of waters described in the First Schedule hereto—

(a) May by bylaw do anything which a harbour board may do by bylaw under section 232 of the Act;

(b) May appoint harbourmasters and/or officers and define or limit their powers or duties;

(c) Shall have all the powers, functions, duties, and authorities of a harbour board under the Act as if it were constituted a harbour board;

(d) May expend money out of its general fund or account for the purpose of exercising and performing the control, power, functions, duties, and authorities conferred by this Order in Council.

  1. Bylaws made by the Council under the authority of this Order in Council shall not come into force until they have been approved by the Minister, by notice in the Gazette.

  2. The rights, powers, and privileges conferred by or under this Order in Council shall be in force for 21 years from the day following the date of its notification in the Gazette unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority.

  3. The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council six calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the Council in New Zealand.

The Land and Income Tax Payment Order 1965

ORDER IN COUNCIL

At the Government House at Wellington this 2nd day of June 1965

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Land and Income Tax Act 1954, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.


ORDER

  1. This order may be cited as the Land and Income Tax Payment Order 1965.

  2. Expressions used in this order have the same meanings as in the Land and Income Tax Act 1954.

  3. This order applies to:

(a) Land tax for the year of assessment which commenced on the 1st day of April 1965; and

(b) Income tax payable for that year of assessment on income derived (or deemed to have been derived) during the income year which commenced on the 1st day of April 1964 by—

(i) Every subsisting company otherwise than as trustee or agent:

(ii) Every public authority otherwise than as trustee or agent:

(iii) Every Maori authority.

  1. Land tax shall be due and payable in one sum on the 7th day of October 1965.

  2. Income tax to which this order applies shall be due and payable in one sum on the 7th day of February 1966.

  3. Land tax and income tax to which this order applies shall be payable at any office of the Taxes Division, Inland Revenue Department, or at any money-order post office.

Exempting Crown Land in the Canterbury Land District From the Provisions of the Mining Act 1926

PURSUANT to the Mining Act 1926, His Excellency the Governor-General hereby gives the following notice.


NOTICE

The land described in the Schedule hereto is hereby exempted from the operation of the Mining Act 1926.


SCHEDULE

ALL that area of Crown land in the Canterbury Land District containing 61 acres, more or less, bounded by a line commencing at the intersection of the mean high-water mark of the sea and a line parallel to and 3 chains west of the western boundary of Lot 1, D.P. 19343, and proceeding northerly along that line to the southern side of a road forming the southern boundary of the said Lot 1; thence easterly along that roadside to a point in line with the eastern side of a road forming the eastern boundary of Rural Section 24350; thence northerly to and along that roadside to a line parallel to and 10 chains north of the mean high-water mark of the sea; thence easterly along that line to the foot of the cliffs near the outlet to Lake Forsyth; thence south-easterly along the foot of the said cliffs to the mean high-water mark of the sea; thence westerly along the said mean high-water mark to the point of commencement and being more particularly delineated on a plan marked Mines 6/4/14, lodged in the office of the Mines Department at Wellington, and thereon edged red.

As witness the hand of His Excellency the Governor-General this 28th day of May 1965.
