Street Closed in the Borough of Taihape

A PROCLAMATION

Pursuant to section 29 of the Public Works Amendment Act 1948, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim as closed the street described in the Schedule hereto.

SCHEDULE

WELLINGTON LAND DISTRICT

All that piece of street containing 2 roods 0-2 perches situated in the Borough of Taihape, Wellington R.D., adjoining part Lot 3, D.P. 5167, being part Section 77, Block XIV, Ohinemairua Survey District; as the same is more particularly delineated on the plan marked M.O.W. 18110 (S.O. 25532) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 24th day of January 1964.

Declaring Land in a Roadway Laid Out in Block II, Taurara Survey District, to be Road

A PROCLAMATION

Pursuant to section 421 of the Maori Affairs Act 1953, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby declare the land described in the Schedule hereto and comprised in a roadway laid out by the Maori Land Court by an order, dated the 8th day of October 1963, to be road.

SOUTH AUCKLAND LAND DISTRICT

All that piece of land containing 1 rood 37-8 perches situated in Block II, Taurara Survey District, being Waipahihi part SF (roadway); as the same is more particularly delineated on the plan marked M.O.W. 18104 (M.L. 18996) deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Stopped Government Road Set Apart for a Microwave Repeater Station in Block IX, Waipu Survey District

A PROCLAMATION

Pursuant to the Public Works Act 1928, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, hereby proclaim and declare that the stopped Government road described in the Schedule hereto is hereby set apart for a microwave repeater station; and I also declare that this Proclamation shall take effect on and after the 10th day of February 1964.

NORTH AUCKLAND LAND DISTRICT

All that piece of stopped Government road containing 30-9 perches situated in Block IX, Waipu Survey District, North Auckland R.D., and adjoining or passing through part Lot 2, D.P. 24461; as the same is more particularly delineated on the plan marked M.O.W. 18086 (S.O. 44177) deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

The Tauranga City Council and Tauranga Electric Power Board Water Power and Electric Lines Licence 1963

ORDER IN COUNCIL

At the Government House at Wellington this 20th day of December 1963

Present:

His Excellency the Governor-General in Council

Pursuant to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited as the Tauranga City Council and the Tauranga Electric Power Board Water Power and Electric Lines Licence 1963.

  2. Subject to the conditions hereinafter set forth, the Tauranga City Council and the Tauranga Electric Power Board (hereinafter referred to as "the licensees") are hereby granted a licence to obstruct, impound, or divert the waters of the Mangapapa, Opuiaki, and Mangakarengorengo Rivers, to raise or lower the level thereof, and to take and use therefrom, for the purpose hereinafter set forth (Ruahihi Scheme), a stream of water not exceeding 600 cu. ft. per second and also to obstruct, impound, or divert the waters of the Opuiaki, Mangapapa, and Omanawa Rivers, to raise or lower the levels thereof, and to take and use therefrom, for the purpose hereinafter set forth (Mangapapa Scheme), streams of water not exceeding an aggregate of 450 cu. ft. per second and also to lay, construct, put up, place, and use the electric lines described in the First Schedule hereto.

  3. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935, shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions of this licence.

  4. This licence is issued under the Water Power Regulations 1934 and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1961, the Radio Interference Regulations 1958, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions of this licence.

  5. (a) The water for the Ruahihi Scheme shall be taken from the Mangapapa, Opuiaki, and Mangakarengorengo Rivers at a point in Lot 475, Block V, Otanewainuku Survey District.

(b) The water for the Mangapapa Scheme shall be taken from the Opuiaki River at a point in Lot 4-985A, Kaimai No. 2 Block, Block IX, Otanewainuku Survey District; from the Mangapapa River at a point in Lot 589, Block IX, Otanewainuku Survey District; and from the Omanawa River at a point on Crown land in Block X, Otanewainuku Survey District.

All as indicated on the plan marked N.Z.E.D. 623 deposited in the office of the New Zealand Electricity Department at Wellington. The water shall be used solely for the purpose of generating electricity.

  1. The licensees are hereby authorised, subject to the conditions hereof, to construct, maintain, and use the works described in the Second Schedule hereto, the position of the said works being indicated on the plan marked N.Z.E.D. 624 deposited in the office of the New Zealand Electricity Department at Wellington.

  2. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.

  3. Nothing in this licence shall of itself be deemed to confer upon the licensees any right to water.

  4. This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1985.

  5. The licensees shall, within six months of the issue of this licence, produce to the Minister of Electricity evidence that an agreed scheme for the joint exploitation of the water resources referred to in this licence has been assented to by the licensees.

  6. The provisions of section 3 of the Public Works Amendment Act 1954 shall apply to the works authorised by this licence as though the duties and powers contained herein were in respect of different public works proposed to be executed on the same land by each of the licensees.

  7. Except as agreed in accordance with clause 10 hereof or as determined in accordance with clause 11 hereof the rights conferred and duties imposed by this licence shall be joint and several.

FIRST SCHEDULE

ELECTRIC LINES

(a) Lines for the transmission of electrical energy commencing at the Mangapapa Power Station situated in Lot 345, Block V, Otanewainuku Survey District, and proceeding in a generally northerly direction to the McLaren's Falls Power Station, and joining the Omanawa Falls - McLaren's Falls 33kV-transmission line marked "C" on the said plan N.Z.E.D. 624.

(b) Lines for the transmission of electrical energy from the Ruahihi Power Station and proceeding in a generally north-westerly direction across the Wairoa River and joining the McLaren's Falls - Tauranga 33kV-transmission line marked "A" on the said plan N.Z.E.D. 624.
